Abstract
본고는 대법원 2015. 7. 13. 선고 2015도3260 전원합의체 판결에 대한 평석이다. 대상 판결의 사안은 인터넷 도박사이트 운영자에 대한 형사처벌을 토대로 하고 있다. 제1심법원이 징역 10월을 선고하자 피고인과 검사는 모두 양형부당을 이유로 항소하였다. 항소심법원은 제1심판결을 파기하고 징역 4년을 선고하였다. 피고인은 항소 심판결에 불복하여 상고하였는데, 제1심 형량의 5배에 가까운 형을 항소심이 선고할 수 있는가를 놓고 대법원의 견해가 나뉘었다. 대법원 다수의견은 항소심의 고유한 양형재량권을 인정하면서 양형부당의 문제에 지나지 않아 상고심의 대상이 되지 않는다고 판단하였다. 이에 대해 소수의견은 항소심의 고유한 양형재량권을 인정하면서도 양형재량의 범위를 벗어난 위법이 인정되므로 상고심의 판단대상이 된다고 주장하였다. 이상의 다수의견과 소수의견에 대해 필자는 문제의 본질이 양형재량에 있는 것이 아니라 항소심의 구조와 관련된 법률위반의 문제라는 주장을 전개하였다. 형사 상소제도를 연혁적으로 고찰할 때 현재의 형사항소심은 속심적 요소를 가미한 사후심의 성격을 가지고 있기 때문에 제1심의 양형판단을 항소심은 원칙적으로 존중해야 한다는 것이다. 이상의 논지를 뒷받침하기 위하여 필자는 한국의 상소제도에 대한 연혁을 일제강점기, 미군정기, 1961년 및 1963년의 형사소송법 개정, 2008년 국민참여재판의 실시라는 시대구분에 따라 점검하였다. 이상의 연혁적 고찰을 토대로 필자는 국민참여 재판제도의 도입이 형사항소심에 미치는 영향과 상고심 업무부담의 경감을 위한 항소심의 새로운 운용 필요성을 강조하였다. 결론적으로 제1심공판중심주의를 확립하고 항소심을 사후심적으로 운영함으로써 상고심의 부담을 경감해야 한다는 것이 필자의 주장이다.



This paper reviews Supreme Court en banc Decision 2015Do3260, decided July 23, 2015, where the punishment on the operator of a gambling website came into question. The defendant was sentenced to 10 months in prison by the first instance court. The defendant and the public prosecutor both lodged an appeal, on the grounds that the amount of punishment sentenced was unreasonable. Later the second instance court quashed the judgment of the first instance court and announced a new judgment; the defendant, this time, was sentenced to 4 years in prison. The defendant lodged a final appeal to the Supreme Court. The justices were divided on the issue of whether the second instance court could extend the amount of punishment to approximately 5 times the original amount of punishment determined by the first instance court. The majority opinion stated that the second instance court had the discretion to determine the punishment, and that the issue of unreasonable amount of punishment did not constitute the reason for final appeal. The dissenting opinion also affirmed the discretion of second instance court, but stated that the second instance court at issue had wrongfully exercised its discretion, which constituted the reason for final appeal. In my view, a final appeal may be lodged against the judgment of the second instance court in this case, as the second instance court violated the law which set upon the role of the second instance court. The historical development of the appeal system in criminal cases suggests that the role of second instance court is basically to deal with the points of law, and the points of fact when necessary. As such, the second instance court ought to respect the first instance courts determination of punishment. In order to support such argumentation, this paper studies the history of appeal system in criminal cases, focusing on how the system has developed going through Japanese colonial era, the U.S. military government, the amendment of criminal procedure act in 1961 and 1963, the introduction of civic participation in criminal trials in 2008. Based on such historical study, I suggest that the role of second instance court be revisited due to the introduction of civic participation system, and that the trial in second instance court be operated in a way mitigating the heavy workload imposed on the Supreme Court. In other words, I suggest that the court of first instance conclude the examination of facts, and the court of second instance concentrate on the matter of law.
