병영문화와 군대인권 : 육군의 인권개선 추진실태를 중심으로

Abstract

한국에서 병영문화와 군대인권에 대한 관심은 민주화 이후 급속히 확대되었

다. 시민사회와 국가인권위원회에서는 과거의 군대에서의 인권침해뿐 아니라

현재의 군대인권실태를 정확히 조사하고 이를 개선할 것을 요구하였다. 육군

또한 신세대 장병들이 적절한 관리를 위해 인권개선위원회를 설치하고 제도개

선을 위해 노력하였다.

최근의 조사를 보면, 군대인권은 급속히 개선되고 있지만, 그 중에서도 가장

큰 성과는 군대인권의 개선이 전투적 상승에 필수적이라는 인식이 확산된 것이

다. 그러나 여전히 시민사회와 군 당군간의 인권실태에 관한 인식의 차이가 크

고, 또한 장병의 권리보호제도를 둘러싸고 국가인권위원회와 군 당국간에는 몇

가지 이견이 존재하는데, 이를 해결하기 위해서는 군대인권에 관한 체계적이고

개방적인 연구와 함께 당사자들간의 신뢰의 축적이 필요하다.

It has been focused on military culture and human rights of soldiers as a hot issue after

the transition to political democracy in Korea. Some NGOs and National Human Rights

Commission are interested in this issue and ask not only to seek the truth of past human

rights violation incidents but also to promote soldiers human rights. Korean Army replied

to this challenge and established the committee for promotion of soldiers human rights.

Some survey researches show rapid promotion of military human rights by diverse

institutional endeavors. Most valuable change is the recognition of the positive relation of

soldiers human rights to military empowering. But there are some unsolved issues related

to the discrepancy of civil society and the authority of army, on one hand, and to different

attitudes between National Human Rights Commission and the Authority of army. It

would be necessary more systematic research and accumulative trust among them.
