민원보상제도의 운영실태와 영향요인에 대한 연구

Abstract

이 글에서는 민원행정 업무가 빈번한 기초자치단체를 대상으로 민원업무처리 중에 행정착오 혹은 처리지연 등이 발생한 경우에 민원인에게 소액을 지급하는 보상제도를 분석하였다. 분석한결과, 보상제도를 도입한 기초자치단체의 수는 많았으나, 그 운영실적은 매우 저조한 것으로 나타났다. 민원 보상과 관련된 규정은 자치법규에 선언적으로 규정되어 있고, 보상금도 소액에 불과하여, 제도의 실효성이 낮은 것으로 평가되었다. 한편, 지역특성을 반영하는 민원환경 요인이 민원보상제도의 운영실적에 영향을 미치는 것으로 나타났다. 즉 도시형 지자체가 도･농복합형과농촌형 지자체에 비해서 민원 수요가 많음에 따라 보상실적도 많았다. 그러나 지역특성이 유사한 도시형 지자체 내에서도 지역 간에 실적이 차이가 발생하는 이유를 보면, 해당 기관별로 일선관료의 행태에 영향을 주는 제도설계가 다르다는 것을 알 수 있었다.

This paper analyzes civil petition compensation systems in local governments with frequent civil services that compensate civil petitioners with small amounts of money when there are administrative errors or undue delays. The results showed that a large number of local governments adopted the system, but the actual operation was not very active. The civil petition compensation system has been evaluated as inefficient since the regulations on civil petition compensation are just prescribed declaratively in local legislation and the compensation amount is negligible. In the other hand, the results showed that the environmental factor reflecting regional characteristics of civil petitions affected operation results. That is, local governments in urban areas resulted in more compensation than those in rural areas since urban area governments had more civil petition demands. However, this paper disclosed different operational results even between area urban governments having similar regional characteristics. This
