2000년대 말 이후 북한의 시장화와 재산권 레짐의 변화 : 재산권의 모호성과 체제이행의 동학

Abstract

이 연구는 북한 김정은 정권의 경제개혁조치를 배경으로 한 사실상의 사유화 확대추세의 체제이행론적 함의를 규명하기 위해 재산권 레짐의 변화라는 관점에서 개인사업자의 재산권 보장 실태를 검토했다. 이를 위해 재산권의 권리다발과 관계성 개념을 분석도구로 활용했다. 검토 결과 (1) 사실상의 사유화의 주된 방식은 국가부문 외피를 빌린 소규모 개인사업 운영 형태의 소극적인 방식이라는 점, (2) 개인사업자 재산권은 업종에 따라 양도권이 제약을 받기도 하지만, 사용권과 수익처분권은 비공식적으로 상당 정도 보장되고 있다는 점, (3) 개인사업의 성장은 지배체제의 정치적 특성에 의해 일차적으로 영향을 받는다는 점, (4) 모호한 재산권은 국가와 개인사업자들 간의 상호의존적인 이해관계의 비공식적 타협의 산물이라는 점, (5) 모호한 재산권 레짐 하에서 국가는 일부 경제부문에서 개인사업자들의 사실상의 사유화 확대를 용인하면서도 시장세력을 억제하고 지배체제를 강화하기 위한 유력한 수단으로 모호한 재산권을 활용하고 있다는 점을 확인했다. 따라서 모호한 재산권 레짐과 연계된 이런 점들에 국한해서 볼 때 북한의 체제이행은 시장과 재산권에 대한 국가의 재량적 규제와 약탈성이 중첩된 모호하고 불투명한 국가 중심성의 상대적 우위에 의해 틀 지워지고 있다고 평가할 수 있다.

The implications of the growing trend of de facto privatization in North Koreas Kim Jong-Un Regime can be found by analysizing private entrepreneurs in terms of the bundle of property rights and the ambiguous property rights regime. The analysis of depth-interviews with some North Korean refugees shows that (1) The dominant mode of de facto privatization is the market-oriented activities of private entrepreneurs with some-sized personal property in the disguised state sector, (2) In terms of the bundle of rights their ambiguous property rights are permitted informally to some degree but constrained by the characteristics of the personal dictatorship system, (3) In some sense, the ambiguous property rights are results of the mutural dependence and implicit negotiation of the state and private entrepreneurs, and at the same time they function as the politico-economic tool with which the state tries to reinforce the dominance of the state over the market force. In view of these findings the changing property rights regime implies that North Korea is under the process of state-centric economic transformation in a little supressed and opaque mode.
