| dc.description.abstract | 국가가 하나의 체제를 이루어 원만히 운영되기 위해서는 법적, 제도적 장치가 필요하다. 이러한 장치들은 특정한 개인이나 소수 집단의 自意에 의해 마련되고 운영될 수는 없으며, 긴밀하게 상호 연관성을 가진 제반 規程에 따르지 않을 수 없다. 이러한 규정은 여러 차원의 것들이 있는 가운데 가장 상위의 규정을 법률이라고 할 수 있고, 이 법률을 成文化하여 모아 놓은 것이 法典이다. 법전의 편찬과 증보는 당대의 사회 변화를 배경으로 이루어졌다. 따라서 법전 편찬의 경위와 그 개정 내용을 분석하면 역으로 당대의 사회상 및 그 변화의 기본 골격을 밝혀낼 수 있다. | - |
