화하는 논변에는 동의 교설과 공정성 논변이 있다. 동의 교설은 개인들의
자발적인 명시적 동의나 묵시적 동의를 통해, 공정성 논변은 정치 공동체
가 제공한 혜택의 상호 보답을 통해 시민의 복종의 의무를 정당화한다. 그
러나 시몬스는 로크의 동의 교설은 묵시적 동의 개념을 혼동되게 사용하고
있다고 비판한다. 한편 그는 공정성 논변의 경우 단순한 수혜와 혜택의 수
용에 대한 구별을 통해 자발성을 담보하는 후자의 경우가 현실적으로 드물
다며 정치적 권위의 정당성을 보장할 수 없다고 주장한다.
그러나 필자는 두 논변에 대한 시몬스의 분석은 치명적인 문제를 안고 있
다고 주장한다. 즉, 우리가 자발성을 보증하기 위해 의도 및 인식 조건에
의해 혜택의 수용과 단순한 수혜를 구별하게 되면 혜택의 수용은 선택 행
위가 되고, 나아가 관계적 선택 행위로서 묵시적 동의에 포섭된다. 이에
따라 공정성 논변은 동의 없이도 정치적 의무가 발생한다고 주장하는 자신
의 설득력을 상실하고 동의 교설에 포섭되는 것이다. There are two types of transactional arguments which justify
individuals obligation to obey political authorities: the consent
doctrine and the fairness arguments. The former justifies it through
individuals giving express or tacit consent; the latter through
reciprocating the benefits a political community offers. However,
Simmons argues, for the former, that Locke confuses tacit consent
with accepting benefits; for the latter, there are few who accept
benefits and therefore, according to Simmons, both arguments do
not apply to the legitimacy of political authority in contemporary
political society.
However, I argue that Simmons faces a critical problem. If he
distinguishes the acceptance of benefits from the mere receipt of
benefits according to his intention and knowledge conditions, the former
becomes a sort of choice act and further is subsumed within tacit
consent as a relational choice act. Therefore, the fairness arguments
maintaining that political obligation arises without individuals consent
lose their convincing force and hence are subsumed into the tacit
doctrine.
