Abstract
이 글은 신제도경제학(new institutional economics: NIE)의 시간과 관점에서 규제와 규제정책의 주요문제들을 재조명해 보려는 데 목적이 있다. 그것이 기존의 주류경제학 혹은 정치경제학의 관점에서 규제이론과 연구에 어떤 새로운 빛을 비추어 주고 있으며, 어떤 면에서 기존이론과 이견을 보이는지 고찰해 보려는 것이다. 신제도경제학의 관점에서 보면 규제의 본질은 공익목적을 내세워 이루어지는 사유재산권에 대한 제한이다. 사유재산권의 보장, 계약자유의 원칙을 핵심지주로 삼고 시장의 자동조정 매커니즘에 의해 움직이는 자본주의 -시장경제체제에서 규제가 본래의 의도와 목적을 효과적으로 달성하는 경우란 의외로 드물다. 이것은 규제정책 분야의 가장 큰 의문 중 하나다. 신제도경제학은 이런 의문의 상당부분에 대하여 의미있는 해답을 제공해 준다. 특히 자본주의-시장경제체제에서 규제는 효과적으로 이루어지기 쉽지 않을 뿐더러 좀 더 장기적인 관점에서 보면 지나친 재산권에 대한 제약이 공익목적의 실현을 방해할 위험성이 매우 클 수 있음을 잘 밝혀준다. This paper collects and reviews new lights that the new institutional economics( NIE) throws on the existing theories of regulation and its main policy issues. In particular, it tries to compare the perspectives of the mainstream economics and the political economy of regulation on the one hand, and the NIE on the other, and to bring its lessons to bear on them. From the perspective of NIE, regulations are, in short, some constraints on private property rights placed in the name of public interest. In capitalist-free market economy, underpinned by secure private property rights and contractual freedom, and subject to the self-regulating and coordinating forces of the market, regulation rarely achieves its policy intentions and objectives, a conundrum that the existing theories of regulation find hard to solve. NIE, this paper contends, has provided insightful and pretty satisfactory answers to many of them. Especially it supplies reasons why regulation not only can hardly be effective but represents wrong approaches and solutions to many economic and social problems. In a nutshell, NIE shows that if the market is left alone to run its course fully, it tends to solve problems better than regulations would do.
