공정거래위원회 수평기업결합 규제의 성과 평가 연구: SK텔레콤 심결사례를 중심으로

Abstract

1999년 12월, 이동통신 시장에서 제1위인 SK텔레콤은 3위 이동통신사업자인 신세기통신과 합병하기로 하였다. 공정거래위원회는 이 기업결합이 경제적 효율성 증진보다는 시장 독과점화의 부작용이 더 크다고 판단하였고, 따라서 2001영 6월까지 시장점유율 50% 이하로 감소시키라는 의결을 하였다. 본 논문에서는 SK텔레콤의 기업결합 이후 이동통신 시장의 독점도와 경제적 효율성 측면에서의 변화를 살펴보고 이를 기반으로 공정거래위원회 기업결합 규제의 성과를 분석 평가한다. 분석결과, SK텔레콤-신세기통신간의 기업결합으로 인하여 독점도 지수는 증가되었지만 시장의 독점력은 증가되지 않았다. 또한, 가격, 생산량, 품질 측면에서 살펴본 소비자 후생은 오히려 증가되었다. 즉, 이동통신 시장은 외면적으로는 독과점적 시장구조이지만, 실질적으로는 경쟁적으로 시장이 운영되고 있다고 볼 수 있다. 따라서 본 사례는 시장집중도 지수를 중심으로 이루어지는 공정거래 위원회의 기업결합 규제가 한계를 지니고 있으며, 각각의 산업과 시장에 적합한 효율성 검증이 이루어져야 한다는 것을 시사하고 있다. In DEC. 1999, SK telecom(SKT), the leading company of the telecommunication market, decided to merge with the Sinsege telecom, the third company in the market. On evaluating that this movement will enable SKT to monopolize the market, the Fair Trade Commission(FTC) ordered SKT to lower its market share by 50% with the due day of JUN. 2001. This study had evaluated the performance of the regulation by monitoring the changes of the market in the context of efficiency and monopoly after the mergence. The result showed that the mergence did increased the monopoly index but didn't give SKT the market monopoly. The consumer surplus, however, did increase in the view of price, quantity and quality. In other words, the contemporary telecommunication market, which seems to have a monopoly structure, is actually a competitive market. Therefore, this study concluded that there is a fallacy in FTC regulations done based on market concentration index and that farther regulations should be verified case by case.
