IMF 위기이후 대기업 규제개혁과 국가역할의 변화: Steven K. Vogel의 재규제와 규제국가 논의를 중심으로

Abstract

본 연구는 IMF위기를 계기로 이루어졌던 대기업관련 규제개혁의 내용을 Vogel의 재규제 유형에 따라 분석하고 이에 대한 함의를 논하였다. IMF위기 이후 한국의 규제개혁은 정부의 시장에 대한 직접적 개입이 약화되고 간접적 개입이나 시장위주로 변화되었다. 그러나 시장행위자들 간의 공정경쟁을 제고하고 위한 규제는 점진적으로 강화되었고 이에 따라 대기업 진단에 대한 규제는 보다 엄격해졌다. 그 결과 정부의 규제형성자로서의 역할과 감독권한은 훨씬 강화되었다. 또한 Vogel의 유형화에 따르면 대기업규제개혁은 경쟁조장적 재규제와 사법적 재규제 방식을 적극적으로 도입하되 확장적 재규제 방식 또한 상당한 수준으로 이루어졌으며 전략적 재규제 방식이 부분적으로 활용된 것으로 분석되었다. 재규제에 대한 논의는 규제개혁=탈규제라는 공식을 벗어나 정부가 다양한 규제개혁의 전략을 활용할 수 있다는 것을 보여준다. 또한 한국은 재규제를 통하여 규제국가로 이행하는 과도기에 있음을 밝혔다. The purpose of this study is to analyze the change of big business regulation after 1997 in Korea and its types and methods of reregulation by Steven K. Vogel. Regulations for the big business made in the 1970s and magnified until the 1990s. In the IMF economic crisis in 1997, the Kim Dae-Jung administration changed the methods and structure of regulatory reform. They brought paradigm shift of regulatory reform on Korea, Kim Dae-Jung called it "a new paradigm for socio-economic development." During this period, they tried to reduce regulations in half and develop the quality of regulations through the extensive regulatory reform. But many regulations for the big business are made and supplemented in this period paradoxically. According to analyzing the types of reregulation for big business, Korean government focuses on making expansionary and pro-competitive using strategic reregulation accessorily. And this paper shows that Korea has more characters of the regulatory state after these reforms.
