일반논문 : 대통령의 입법의제로서 정부법안의 국회제출과 통과의 영향요인: 민주화 이후 역대 정부를 중심으로(1988-2007)

Abstract

이 연구는 민주화 이후 한국에서 정부법안의 국회제출 및 통과의 변화와 그 영향요인에 대하여 분석하고자 한다. 발견된 사실을 요약하자면 첫째, 정부법안의 국회제출의 변화를 살펴보면 김영삼, 김대중 정부에서는 집권 초기에 법안 제출이 증가하였다가 임기 말로 갈수록 감소하는 추세를 보였으나, 노태우, 노무현 정부에서는 집권 초부터 집권 후반기까지 점차 증가하다가 임기 말에는 감소하는 형태를 나타내었다. 둘째, 대통령의 입법의제로서 정부법안의 국회제출의 변화에 대한 영향요인을 분석한 결과 대통령의 국정수행에 대한 국민의 지지도와 대통령의 입법의제의 변화 간에는 양(+)의 상관성이 있는 것으로 확인되었다. 또한 대통령의 잔여 임기가 감소함에 따라 정부법안의 국회제출의 변화는 증가하는 것으로 확인되었다. 셋째, 정부법안의 국회통과에 대한 영향요인으로는 대통령의 국정수행에 대한 국민의 지지도의 변화와 정부법안의 국회통과 건수의 변화가 양(+)의 관계로 확인되었으며, 대통령의 잔여 임기가 감소함에 따라 정부법안의 국회통과 건수의 변화는 증가하는 것으로 확인되었다. 위에서 발견된 사실을 이용하여 앞으로 대통령의 입법적 활동과 관련하여 몇 가지 정책적 시사점을 제시하자면 다음과 같다. 첫째, 정치적 맥락으로서 대통령에 대한 국민의 국정지지도와 정부법안의 국회제출 및 통과 간에 유의미한 관계가 있음을 고려할 때 대통령은 입법적 성공을 위하여 국민의 여론을 지속적으로 확인하고 이를 국정에 반영하기 위한 대통령 보좌기구의 기능과 제도를 확충하여야 한다. 둘째, 대통령은 시간이 지날수록 국정에 관한 지식을 취득하여 더 많은 입법의제를 제기할 수 있지만 입법적 성공의 중요한 요소인 국정지지도는 임기 초에 비교적 높게 나타나므로 대통령 당선자는 시간적 제약을 고려하여 정권인수과정에서 추진되어야 할 입법과제와 우선순위를 확정하고 임기 초부터 적극적으로 국회 또는 국민에게 제시하여야 한다. This study explores changes and factors influencing executive legislation introduced in the National Assembly since democratization. It also analyzes the legislative success of executive legislation introduced in the National Assembly. To sum up the findings in this study, firstly, the introduction of executive legislation increased early in the terms of the Kim Young-sam and Kim Dae-jung Administrations and decreased toward the end of their presidencies, but it gradually increased in the Roh Tae-woo and Roh Mu-hyun Administrations toward the end of their presidencies and sharply decreased at the end of their terms. The results of the analysis show that the introduction of executive legislation and its legislative success positively correlated with the approval rate of the incumbent government. The remaining term of presidency is also found to be positively related to the introduction of executive legislations. To make some suggestions using the findings of this study, the president should ascertain public opinions and assume the leadership of public discourse. As the rate of support for the president is relatively high early in the term of a president, the presidential legislative agenda should be proposed actively early in the term of presidency, which makes it more plausible for the president to promote his (her) agenda successfully.
