통일헌법의 기본원리 소고

Abstract

통일헌법은 통일과정에서의 헌법, 통일시점에서의 헌법, 통일 후의 헌법이라는 각 단계별로 거쳐야 할 과정이 있을 것이다. 이 세 가지 과정을 거치는 사이에 지켜져야 할 갖추어야 할 기본적인 덕목이 무엇인지를 고민하는 것은 앞으로 통일시대를 대비하는 첫 걸음이라 할 수 있다. 첫째, 통일헌법은 인류의 보편적 가치에 입각한 입헌주의적 헌법질서를 존중하는 가운데 형성되어야 한다는 점에서 근대 입헌주의 헌법에서 현대 사회복지국가 헌법에 이르기까지 쌓아온 헌법의 소중한 원리에 입각할 때 진정한 통일헌법으로 자리매김할 수 있을 것이다. 둘째, 통일헌법은 그 전문과 총강에서 인류보편의 헌법적 가치를 포섭해야 할 뿐 아니라 한반도 유일한 정부로서의 국가적 정체성을 담보하는 헌법이어야 한다. 바로 그런 의미에서 그 국가는 단순히 적법성만 담보할 것이 아니라 정통성까지 담보하는 그런 국가의 기본법이 되어야 한다. 셋째, 이상적으로는 통일의 과정에서 1국2체제가 가능할지 모른다. 그러나 현실적으로 1국2체제가 가능할 것인지 의문이다. 바로 그런 점에서 궁극적으로 자유민주주의에 입각한 국가형태의 구축이 불가피하다. 하지만 그 자유민주주의는 인민민주주의를 배척하는 자유민주주의가 아니라 인민민주주의까지 포섭하는 자유민주주의여야 한다.

The Constitution of a United Korea will undergo a process of three steps, that is,

before unification, during unification and after unification. But the first initiative towards preparing the Korean unification must be the recognition of fundamental virtues that need to be upheld during the unification process involving the three steps

aforementioned. First, having in light the fact that the Constitution of a United

Korea needs to be built respecting a constitutional order based on universal values, we can only compose a Constitution of a United Korea when it is based on the

principles that have been built since the modern constitutionalism constitution to the

modern social welfare constitution. Second, the Constitution of a United Korea has to not only include universal values in its preamble and Chapter One, but it also has to be able to guarantee the national identity of the Korean government as the sole government in the Korean peninsula. It is in this sense that the Constitution should become the fundamental law securing both the legality and legitimacy of the state. Third, it may be ideal to achieve a one-nation-two-system structure during the transition period for unification. Yet it is still doubtful whether that could be even possible. This is why it is inevitable to build a nation based on liberal democratic

values. However, it is to note that these liberal democratic values should be broad

enough to also embrace the people's democratic ideals.
