지구화와 행정법의 대응

Abstract

지구적 차원에서 내려지는 결정은 작게는 국민 개개인의 권리․의무에 영향을 미

치고, 크게는 근대 국민국가의 통치구조를 변화시킨다. 본고는 지구화가 공법, 특히

행정법에 대하여 어떤 영향을 미치는가, 그리고 이를 여하히 인식하고 대응하여야

하는가를 살피기 위하여 구상되었다. 이를 위해 본고는 먼저 지구화의 제상(諸相)을

살펴봄으로써 얻게 된 본질적 요소를 행정법문제화한 후 이것이 국가를 둘러싼 법적

관계를 여하히 변용시키는지를 살펴본다. 여기서는 지구화가 국민의 권리와 민주주의에 대하여 미치는 영향을 주로 살펴볼 것이다. 이어서, 본고는 자유민주주의를 준거가치로 하여 지구화에 대한 헌법적 평가를 행한 후, 입법부, 행정부, 법원에 의한 공법적 대응 방안을 논할 것이다. 본고는, 마지막으로 지구화와 관련해 제기되는 국제법적 논점을 살핀 후, 지구화에 대한 행정법학의 응전이 성공적일 것임을 예견한다. Decisions made on the global level not only have influence on rights and obligations of individuals, but also bring structural changes in the governmental system of modern nation-state. This paper aims at examining the impacts of globalization on public law, in particular, on administrative law, and contemplating how these impacts are evaluated and dealt with in terms of administrative law. To meet this goal, this paper first identifies a wide variety of aspects of globalization, translating them into questions of administrative law in order to see the influence of globalization on

various legal relationships in which a nation-state is involved. The focus here is

mostly on how democracy and individual rights are affected by globalization. Next, globalization will be analyzed through constitutional assessment based on the values of liberal democracy. Then, the possible responses of public law adoptable by each legislative, administrative and judicial body will be discussed. Finally, the paper will review international law issues of globalization and conclude with an optimistic prospect that administrative law scholarship will successfully meet the legal challenges that globalization provides.
