한국의 정부형태 및 권력구조 논쟁: 쟁점의 본질과 효율적 대안

Abstract

한국에서 권력구조개편론(또는 개헌론)은 현행 대통령제를 내각책임제，2원집정부제 또는 미국식 대통령제로 고치자는 형태로 제기되어왔다. 근래의 논의는 대통령제를 유지하되 미국처럼 고치자는 식으로 진행되고 있다. 핵심적인 이슈는 대통령에게 권력이 지나치게 집중되는 것을 방지하고 분점 정부의 문제를 극복하는 것이다. 그런데 미국에서 이 문제가 심각하게 제기되지 않는 것은 대통령의 임기 때문이 아니라 선거제도와 정치행태 등 미국 특유의 조건 및 환경 때문이다 미국식 대통령제를 비롯한 여타 점부형태가 위 두 가지 문제의 해결을 담보하지 못한다. 더구나 대통령으로의 권력집중과 분점정부의 문제는 개헌보다 훨씬 작은 사회적 비용을 요하는 하위 법의 개정으로 극복할 수 있다. 따라서 완벽하지 못한 헌법이라도 유연하게 해석하고 하위 법을 개정하는 방식으로 정부형태나 권력구조의 문제에 대처하는 것이 합리적이다.

Arguments for constitutional amendment have been raised to change the current government type of presidentialism to cabinet system, dual executive system or the American style presidential system. The arguments aim at deterring concentration of political power to the president and also overcoming problems originating from the divided government. The two issues have not been seriously raised in the States not because of the 4 year –dual term presidency but because of political environment involving electoral system and political behavior that are peculiar to the country. The American type presidential system by itself cannot guarantee any solution to these two problems in cay countries. 만lese problems can be overcome by revising the concerned laws rather than amending the constitution, which incurs far higher social costs, in Korea. Therefore， it is rational to deal with the issues of government type and power structure through revision of the concerned laws rather than change of the charter.
