Abstract
본 논문은 흄의 저작에 나타나는 정파의 문제와 법치를 다룬다. 흄은 정파의 원인이 인간본성에서 기인한다고 보고 있으며 이런 이유로 정치의 본성 또한 쟁(爭)의 성격을 갖는다고 본다.
그에 따르면, 인간의 본성은 고칠 수 없는 반면 그것이 드러나는 방식(Manner)은 수정이 가능하다. 「영국사」를 통해서 흄은 칼싸움 중심의 정치가 말싸움 중심의 정치로 교정되는 과정을 그린다. 원칙 중심의 정파가 등장하게 되는 것도 논쟁 중심의 정치로 전환되는 과정의 일부를 이룬다. 이런 긍정적 측면에도 불구하고 원칙 중심의 논쟁은 논쟁 극단화라는 폐해를 일으킨다. 그리고 논쟁의 극단화는 정치적 소통에 장애를 가져온다. 이를 완화하기 위해서 흄은 정화(circumstances) 중심의 법적 사고를 전개한다. 원칙에 입각한 논쟁은 공동체가 처한 정황에 대한 폭넓은 반성에 의거할 때 그 적절함을 얻을 수 있다. 다시 말하면 법은 공동생활의 필요에 근거해야 한다. 그리고 법의 기준은 원칙에 따른 세련된 기준이 아니라 정황에 따른 일반인의 일상적 행위기준에 두어져야 한다. 이런 법적 사고를 통해서 흄은 원칙중심주의의 편협을 비판함과 동시에 자의적 권력사용(편의주의)에 제한을 가한다. 궁극적으로 흄은 온건한 논쟁 중심의 정치적 관행을 통해서 정치세계를 활성화하고자 한다.

This article concentrates on reorganizing the themes of factions and the rule of law in the works of David Hume. For him, causes of faction are embedded in human nature and, for the same reason, war is inherent in the nature of politics. But the manners of men are susceptible of correction, despite the fact that human nature is unchangeable. In the History of England, Hume tries to describe the great transition from "the war of the sword" to "the war of the pen," During this transition did parties of principle arise and, in a manner, contribute to constituting the debate-oriented politics. Despite their positive aspect, however, parties of principle brought about their own evils, particularly, "keenness in debate," which leads to the absence of communication among parties. For this reason, Hume introduces the spirit of the common law, that is, the circumstances-oriented thinking, to moderate the extreme intensification of party-conflicts: parties of principle in debate can obliterate their keenness, with an enlarged reflection on the circumstances of common life alone. Differently put, the law should be founded upon the necessities of community. And the standards of the law should be grounded upon the general standards of common men in the given circumstances, not upon the refined ones from principles. Hume's legal thinking can not only criticize legal rationalism but also set bounds on the arbitrary exercise of authority. Most of all, he aims at activating the political world by way of the practice of mild debate among parties.
