예비후보자제도와 선거운동기회의 불평등성: 선거운동의 자유와 공정성을 중심으로

Abstract

본 연구의 목적은 현직의원과 도전자 간 선거운동기회의 자유와 공정성을 보장하기 위해 2004년에 도입한 예비후보자제도가 도입 취지와 목적에 부합하지 않는 정치적 결과를 생산하고 있음을 분석하고, 선거운동기회의 불평등성을 극복하기 위해서는 불필요한 규제제도인 예비후보자제도의 폐지와 상시적인 선거운동을 가능하게 하는 제도 개혁이 필요함을 주장하는 것이다. 예비후보자제도는 과열·불법·부정선거를 방지하기 위한 주요 원칙으로 선거운동기간을 규제한 공직선거법 하에서 선거운동의 자유와 평등한 기회의 보장을 위해 도입되었다. 본 연구는 예비후보자제도가 도입취지에 부합하는 결과를 산출하였는지를 현직의 이점에 따른 현직 재당선율과 선거법 위반사례 비율의 증감을 중심으로 평가하였다. 그 결과, 예비후보자제도가 여전히 현직의원과 도전자 간 선거운동기회의 자유와 공정성을 침해하고 있으며, 선거운동기간의 증가가 과열선거 및 부정선거의 증가에 영향을 미치지 않음을 확인하였다. 따라서 예비후보자제도가 또 다른 불필요한 규제이며, 이를 극복하기 위한 방안으로 예비후보자제도의 폐지와 상시적인 선거운동의 허용이 요구됨을 제안한다.

In 2004, the pre-candidate system was introduced to ensure the freedom and fairness between incumbent and challenger campaign opportunities. The purpose of this study is to examine the function and effect of the pre-candidate system. Accordingly, this study focuses on the incumbent re-election rates through advantages of the incumbent and the rates of electoral law violations. As a result, the system infringes upon the freedom and fairness of electoral campaign between incumbent and challenger. The pre-candidate system is the unnecessary regulatory institution. Therefore, this study suggests abolishing the pre-candidate system and allowing a routine electoral campaign in order to overcome inequalities of campaign opportunity.
