연방제도 다양성과 통일한국 연방제도의 함의

Abstract

본 논문은 복수의 정부단계 간 중앙집중화와 탈중앙화의 압력을 자신에게 유리한 균형점으로 이끌어내려는 끊임없는 탐색전의 결과물인 연방제도의 다양성에 관한 일고로부터 통일한국 연방제도의 함의를 도출하고자 한다. 정부조직형태로서 연방제도는 대내외적으로 위기에 대처할 수 있는 강력한 중앙정부와 국민에게 근접한 거주지에서 작동하는 기능적 지역-지방정부의 장점을 극대화하는 것을 목표로 한다. 이는 중앙과 비중앙을 국가라는 단일한 인위적 정치 공동체로 통합하면서도 비중앙의 등가성을 보장하는 다층 거버넌스를 요구한다. 따라서 연방주의가 중앙과 비중앙 간 공치(共治)와 자치(自治)의 균형접에 대한 공감대를 제공하는 경우, 연방제도는 공유 연방주권(shared federative sovereignty)을 구현할 수 있다. 그렇다면 통치원칙으로서 연방주의가 구현된 연방제도에 보편적으로 성립되는 공치(共治)와 자치(自治) 간 균형점은 어떠한 형태로 나타나는가? 또한 헌법상 연방주의를 통치 원칙으로 정립한 연방국가는 수직적 권한 분산을 어떠한 방식으로 구현하는가? 더불어 연방제도의 다양성에 관한 일고를 통해 얻을 수 있는 통일한국의 연방제도에 대한 함의는 무엇인가? 본 논문에서는 이에 순차적으로 답함으로써 연방제도화(federalization)의 조작적 정의를 도출하는 후속연구에 대한 초보 작업을 수행하고자 한다.

This paper first delineates varieties of federal systems in which multiple levels of governments vie for an equilibrium point between centralization and decentralization. A federal system must combine the advantages of a strong national government to manage both internal and external crises, with those of functional subnational governments to respond to public demands. Such rule of governance in which national and subnational governments are integrated into an artificial yet single political entity of nation-state is possible, only if federalism can substantiate regional self-rule plus shared rule. Federalism is a continuous process in which multiple levels of governments are engaged in the search of an equilibrium between centripetal and centrifugal forces. Therefore, federal systems have varied and continue to do so. In this paper, I explore implications toward a federal system of post-unified Korea by explicating the multiplicity of equilibria between shared-and self rule, and the division of power across multiple layers of government. In so doing, I purport to develop an operational definition of federalization in an ensuing work.
