한국, 중국, 일본 3국의 양자 간 투자협정(BIT) 체결 양상 비교 연구

Abstract

본 연구에서는 무역부문에 비해 상대적으로 관심과 연구가 적었던 해외직접투자 규범에 대한 최근의 관심증가를 반영하여 현재 가장 대표적인 해외직접투자 규범으로 역할을 수행하고 있는 양자간 투자협정(BIT: Bilateral Investment Treaty)에 관한 다양한 이론적 논의들을 검토하면서, 특히 한국·중국·일본 삼국의 BIT 체결과정, 원인, 함의 등을 비교하여 설명하였다. 본 연구를 통해 중국과 한국은 1990년대 이후부터 현재까지 세계 각 지역의 다양한 국가와 BIT를 매우 적극적으로 체결한 반면, 일본은 소수 아시아 국가들과만 BIT를 체결하여 소극적으로 활용하고 있음을 확인하였다. 3국의 해외직접투자 유입 및 유출 구조를 고려할 때, 한국은 실질적인 투자유치나 자국 투자보호보다는 경쟁에 뒤처지지 않기 위한 전략으로, 일본은 자국기업의 해외직접투자 자산 보호를 위한 목적으로, 그리고 중국은 경쟁적 고려와 자국 투자자산 보호라는 복합적인 목적으로 BIT를 체결하고 네트워크를 구성해 왔다고 주장하였다. 아울러 중국은 아시아 유럽 아메리카 아프리카를 모두 포괄하는 네트워크로, 한국은 아시아와 유럽 중심의 네트워크로, 일본은 아시아 중심의 네트워크로 발전해 왔음을 밝혔다.

This article is a comparative study to analyze the motives and aspects of the signing of the Bilateral Investment Treaty (BIT) in Korea, China, and Japan. After a short introduction of theoretical discussions regarding BIT, this study shows that China and Korea have concluded the BITs with quite a few countries around the world, including the developed and developing countries in Asia, Europe, America, and Africa, while Japan has concluded the BITs only with a small number of Asian countries. Korea has seemed to sign the BITs, mainly due to the competitive economic pressure to capture a share of foreign direct investment, while Japan has had a clear motive to protect Japanese foreign direct investment in Asia. China has shown multiple motivations for protecting Chinese overseas firms and considering economic competitiveness of China.
