캘리포니아 주를 통해 본 미국의 민주주의

Abstract

대의민주주의와 직접민주주의는 민주주의라는 절차를 통해 민의를 정책에 반영하는 완벽한 이익대변을 추구한다는 공통된 목표를 지향하지만 종종 상호배타적이다. 대의민주주의 옹호론자들은 직접민주주의 체제가 현대 복합사회에서 양질의 입법과 이익 간 공평하게 균형을 맞추는 임무를 수행하기에 역부족이라고 단정한다. 더구나 직접민주주의 요소조차 극단적이거나 편협한 이익집단들의 전횡을 야기해 오히려 효율적이고 공평한 대의민주주의를 구현하는 데 방해가 된다고 주장한다. 반대로 직접민주주의 옹호론자들은 시민 개개인이 거부권 행사를 위협하여 대리인에게 책임 있는 입법, 집행 및 사법을 유도함으로써 시민의 권리헌장인 헌법을 수호할 수 있다고 주장한다. 즉 직접민주주의 요소는 대의민주주의의 취약점을 보완하여 비로소 완벽한 이익대변을 가능케 한다고 역설한다. 현대 복합사회에서 직접민주주의 요소에 대한 고려는 대의민주주의가 제대로 작동하지 않는 경우를 전제한다는 사실 하나만으로도 충분한 논쟁거리를 제공한다. 근대 민주주의의 창시자 중 하나인 로크는 통치자와 일부 인민 간 의견충돌이 발생하는 경우 인민 집합체가 심판을 맡는 것이 적절하다(242)고 단언했다. 직접민주주의와대의민주주의 간상관성을 둘러싼 지속적 논쟁은 어찌 보면 로크가 남긴 격언 자체에 대한 평가라기보다 엘리트 통치체제의 전복을 가져올 수도 있는 혁명이라는 고비용의 갈등 해소법을 회피하기 위한 몸부림의 흔적이라고 볼 수 있다. 이 논문은 우선 미국의 민주주의를 민주주의 논의 틀에서 검토한 후, 분층(multi-layered) 이익대변이 특징인 미국의 민주주의의 발전 배경과 현황을 살펴보고 이 중 특이한 형태로 대의민주주의와 직접민주주의의 조합을 취한 캘리포니아 주의 운영 사례를 살핀 후 결론에서 미국 민주주의의 진면모를 평가해보고자 한다.

Despite their common goal of perfect representation, representative and direct democracies are often mutually exclusive. Proponents of representative democracy argue that direct democracy cannot afford a well-balanced coordination between quality legislation and responsive representation in the modern complex society. Furthermore, the proponents argue that some forms of direct democracy are even taken advantage of by the organized special interest groups only to disrupt the fair and equal representation of the majority in representative democracy. Advocates of direct democracy, in contrast, argue that citizens' direct participation or even a threat of a potential veto may induce their political delegates to strive for responsible legislation, execution, or adjudication so as to protect the fundamentals of constitutionalism. Noticeably, not all forms of direct democracy are alternatives to representative democracy but rather its supplement. Whichever side one takes, it is controversial enough that factors of direct democracy are taken into consideration only if representative democracy is put on a trial for its performance in the modern complex society. Locke, the father of modern democracy, stated that "If a controversy arise betwixt a prince and some of the people, in a matter where the law is silent, or doubtful, and the thing be of great consequence, I think the proper umpire, in such a case, should be the body of the people (Art. 242)." Subsequent debates about direct democracy, therefore, does not necessarily constitute an endeavor to interpret what Locke really meant by it but a conscientious struggle to avoid an excruciatingly expensive conflict conducive to a regime instability or even its demise such as a social upheaval or even a revolution. In this paper, I purport to review theoretical arguments of democracy of various shades, examine the historical backgrounds of direct democracy introduced at the state level in the U.S. and the actual practices across 50 states, and explore how the state of California manages or fails to integrate representative and direct democracy at the state level.
