규장각 소장본으로 본 개항기 서양 국제법 서적의 수입과 간행

Abstract

19세기 후반부터 동아시아에 서양의 국제법 관련 연구서들이 한문으로 번역되기 시작하였으며, 중국 주재 선교사였던 마틴(W.A.P.Martin, 1827~1916)에 의해 주로 이 작업이 이루어졌다. 미국의 저명한 국제법학자 휘튼(Henry Wheaton‚ 1785~1848)의 책을 번역한 <萬國公法>(1864)을 필두로 <星軺指掌>(1876, 원저자; 마르텐스[Charles de Martens, 1790~1863]), <公法便覽>(1877, 원저자; 울지[T.D.Woolsey, 1801~1889]), <公法會通>(1880, 원저자; 블룬츨리[J.C.Bluntschli, 1808~1881]) 등이 차례로 漢譯되어 동아시아에 소개되었다. 이들의 현재 서울대학교 규장각한국학연구원 및 중앙도서관 고문헌자료실 소장 상황을 살펴보면 다음과 같다. 개항기 및 일제강점기 하에서 작성된 주요 서목들의 기재 상황 및 藏書印등으로 미루어볼 때, <공법편람>의 경우 경성제국대학 도서관 시절에 수집된 것으로 보인다. 반면 <성초지장>은 集玉齋및 帝室圖書를 거쳐 조선총독부 取調局→ 參事官分室→ 京城帝大→ 서울대→ 규장각의 전형적 코스를 거친 것으로 추정된다. <만국공법>과 <공법회통>은 규장각 도서 총목록인 <帝室圖書目錄(1909)>에 기재되어 있지 않은데, 이는 이들이 고종이나 순종의 개인 열람도서였기 때문인 것으로 여겨진다. 마틴이 한역한 4종의 도서 중 유일하게 조선에서 간행된 <공법회통>은 현재 규장각 소장본의 입수 경로가 매우 다양하게 나타난다. 여기서 당시 조선의 국제법 지식 습득의 통로가 공법회통으로 편중된 현상을 엿볼 수 있다. 이는 동아시아의 법전 편찬체계 및 회통이라는 書名이 주는 어감 등으로 인해 <공법회통>을 서양 국제법을 집대성한 책으로 인식함에서 유래했던 것으로 추측되며, 당시 만국공법적 국제질서의 냉엄한 약육강식 현실에 대한 정확한 이해를 방해한 측면이 있었던 것으로 여겨진다.

In late 19th century, several western books on international law began to be translated into Chinese character, mostly performed by William Martin, an American Christian missionary in China. Henry Wheatons <Elements of International Law> was translated as <Manguk-Gongbup(萬國公法)>, Charles de Martens <Le Guide Diplomatique> as <Sungcho-Jijang(星軺指掌)>, Theodore Woolseys <Introduction to the Study of International Law> as <Gongbup-Pyunram(公法便覽)>, and Johann Bluntschlis <Das moderne Völkerrecht der civilisierten Staten als Rechtsbuch dargestellt> as <Gongbup-Hoetong(公法會通)>. Investigating the situation of possession for these books in Kyujanggak Institute for Korean Studies at Seoul National University and SNU Library, <Gongbup-Pyunram> seems to have been collected by Keijo Imperial University(京城帝國大學) in the period of Japanese occupation, while <Sungcho-Jijang> by Chip-ok-jae(集玉齋), King Kojongs royal Library. <Manguk-Gongbup> and <Gongbup-Hoetong> is omitted from the Index of Royal Books(<帝室圖書目錄>) in 1909, meaning that Ko-Jong(高宗) or Soon-Jong(純宗) kept and read these books in private. <Gongbup-Hoetong>, solely published in Chosun among 4 books, have been collected to Kyujanggak via various courses, implying that the root for gaining knowledge of international law in Chosun leaned too much towards <Gongbup-Hoetong>, which interrupted Chosun peoples correct understanding for the jungle law reality of world order.
