조선말기 살인사건 조사의 과학성 검토, 1895-1907 - 규장각 소장 檢案에 수록된 凶器 그림의 기초 분석

Abstract

檢案은 조선후기에 살인 사건을 조사하고 보고한 대표적 기록이다. 검안에는 다양한 그림이 그려져 있지만, 지금까지 연구자의 관심을 끌어온 것은 주로 屍帳에 그려진 시체의 개형, 즉 仰面과 合面이었다. 이 논문에서는 연구 방법론의 전환을 통한 새로운 시도를 위해, 살인 사건에 사용된 凶器가 검안의 말미에 그려져 있다는 점에 주목하였다. 검안에 그려져 있는 흉기의 이미지와 측정 기록을 취합하여 분석함으로써, 조사 과정에서의 실측 여부에 대해 확인하고 檢屍의 과학성‧객관성을 검토해 보았다. 또한 검안의 작성 및 보고 절차로서 圖畫上送이 가지는 의미에 대해 고찰하는 과정에서 당대의 수사 현장에서 이루어진 행정의 형식주의를 포착하였다. 생활사 연구의 자료로서 검안의 사료적 가치를 재발견한 것도 이 논문의 성과 중 하나이다.

A traditional post-mortem report, called kŏman, was one of the records typically used to investigate murder cases during the late Chŏson Dynasty in Korea. Despite the variety of pictures available in kŏman, only the shape of corpses (including the front and back views) has attracted the attention of researchers thus far. The current study applies a new methodology that involves pictures of homicide tools used at the end of kŏman. In particular, rough sketches of murder weapons and their dimensions as reported in kŏman are empirically analyzed. Results of the study are as follows. First, whether the weapons have been actually measured is reevaluated. Second, the objectivity of a post-mortem examination is critically analyzed. Third, the reinterpretation of the report process indicates the formalism of public administration during on-the-spot inspections in the late Chŏson Dynasty. In addition, this study demonstrates the value of kŏman as a historical material in conducting research on the history of everyday life.
