노인의 생전유언과 대리인 지정 및 관련요인 조사연구 : Perceptions, preferences and related factors of Korean elders toward Living Will and Durable Power of Attorney

Abstract
현재 우리나라는 사전의료의향서 제도가 법제화되어 있지 않고 기관 별로 사용하는 사전의료의향서는 생전유언과 대리인 지정의 분리 구분없이 통합형태로만 존재한다. 따라서 사전의료의향서의 핵심요소인 생전 유언서와 대리인 지정서를 구분하여 접근하는 연구가 없었기에 실제 노인들이 이들 문서를 어느 정도 인식하고 있으며 어떤 문서를 선호하는지 알아볼 필요가 있다.
본 연구의 목적은 복지관 이용 노인의 사전의료의향서에 대한 인식과 선호를 파악하고 이에 영향하는 요인을 조사하여 노인의 사전의료의향서 작성 시 의사결정을 도모하고 이를 제도화하는데 근거자료로 활용하고자 한다.
본 연구의 자료수집은 2012년 8월 13일부터 9월 8일까지였다. 자료수집 전에 해당 노인 복지관으로부터 연구의 허락을 받은 후, 서울대학교 간호대학 연구대상자 보호 심의위원회의 승인을 받았다. 대상자는 총 180명이었으며, 대상노인과 구조화된 설문지로 일대일 개별면담을 통해 설문을 완료하였다.
자료수집도구는 사전의료의향서, 생전유언 및 대리인 지정에 대한 인식과 선호, 대상노인의 일반적 특성 및 건강상태, 가족기능과 종교참여도에 관한 문항을 구성하여 사용하였다. 수집된 자료는 연구 목적에 따라 실수와 백분율, 평균과 표준편차, χ²및 t-test, logistic regression analysis를 통해 분석하였다.

본 연구의 결과는 다음과 같다.
첫째, 본 연구에 참여한 복지관 이용 노인은 여성이 75.6%였으며 평균연령은 73.56(±6.33)세였고 교육 정도는 초졸 이하가 43.9%였다. 생전유언 및 대리인 지정에 대한 인식을 보면 연구 대상자의 76.7%가 생전유언을, 83.3%가 대리인 지정을 전혀 들어본 적이 없다고 하였고 오직 7.2%가 생전유언을, 5.6%가 대리인 지정을 정확히 인식하고 있었다.

둘째, 생전유언 및 대리인 지정에 대한 선호에서는 연구 대상자의 31.7%가 두 문서 모두 작성하기를 원했고 17.8%는 생전 유언서만, 21.7%는 대리인 지정서만 작성하기를 원했다. 그리고 대리인 지정을 원하는 대상자 중 62.5%는 자녀를, 18.8%는 배우자를 대리인으로 지정하고 싶다고 하여 주로 가족을 대리인으로 지정하기를 원하는 것으로 나타났다.

셋째, 연구 대상자의 생전유언 선호에 영향하는 요인을 보면 남성 노인에서, 대졸자에서, 본인이 최종의사결정자일 때, 한달 소득이 50만원 이상일 때 생전 유언서 작성을 더 선호하는 것으로 나타났다. 생전유언 선호 예측요인에서는 남성이 여성보다 2.152배, 교육수준에서 중졸 이하보다 고졸 군은 3.515배, 대졸 군은 4.867배, 가족 내 최종의사결정자가 본인일 때 타인보다 1.966배 생전유언 선호도가 높았으며 한달 소득은 50만원 이상이 50만원 이하보다 3.464배 선호도가 높았다.

넷째, 대리인 지정 선호에 대한 영향요인에서는 종교가 없고, 자녀와 한 달에 1회 이상 접촉할 때, 한달 소득이 50만원 이상일 때, 소소한 병원비 및 큰 병원비를 부담할 때 가족의 도움을 받는 경우에, 한 달에 의료기관 방문 횟수가 적은 경우, 가족기능이 좋은 경우 대리인 지정서 작성을 더 선호하는 것으로 나타났다. 대리인 지정 선호 예측요인에서는 종교가 없는 군이 있는 군보다 2.229배, 자녀와 접촉 정도는 1달에 1회 이상이 1회 미만보다 2.398배, 한달 소득은 50만원 이상에서 50만원 이하보다 1.966배 대리인 지정 선호도가 높았다. 소소한 병원비 부담 방법에서는 정부보조를 받는 군보다 본인이 부담하는 군은 3.747배, 가족의 도움을 받는 군은 3.929배, 큰 병원비 부담의 경우 정부보조를 받는 군보다 본인 부담에서 3.643배, 가족의 도움을 받는 군에서 3.901배 선호도가 높았다. 한 달간 의료기관 방문횟수는 2회 이상보다 2회 미만에서 2.111배 선호도가 높았다.

이상의 연구 결과 우리나라 노인들은 두 문서에 대한 인식률이 낮았지만 용어의 의미를 이해한 후 절반 가량이 각각의 문서에 대해 작성 의사를 보여 교육을 통해 사전의료의향서 제도를 활성화 시킬 수 있을 것으로 보인다. 또한 두 문서에 대한 선호도 및 관련요인에 있어 차이를 보였는데 이는 간호사가 대상자와 사전의료의향에 대해 논의하게 될 때 대상자의 바램을 이해하는데 도움이 될 뿐만 아니라 대상자가 원하는 문서를 선택할 수 있도록 지지할 수 있으며 사전의료의향서 작성 시 필요한 간호 중재 개발에도 도움이 될 것이다. 본 연구에서 가족기능은 오직 대리인 지정과 관련이 있었으며 생전유언에는 영향을 미치지 않았다. 종교참여도는 대리인 지정 뿐만 아니라 생전유언에 어떠한 영향도 미치지 않은 것으로 나타나 선행연구와 상반되는 결과로 반복연구를 통해 다시 확인할 필요가 있다.

In Korea, because of the cessation of useless life sustaining treatments, the need for introducing Advance Directives(AD) has become a social imperative among elderly and their healthcare providers. Although AD is used in some organizations, it is not a law to provide AD or what AD has to be. Also, the organizations that provide AD focus primarily on both Living Will and Durable Power of Attorney. Its important to know what AD Korean elders may prefer given the limited options or even if these options represent their needs. More importantly, there has been no formal study conducted about preferences and related factors of Korean elders in regards to Living Will and Durable Power of Attorney or possible AD option they may need.

Thus, the purpose of this study was to investigate Korean elders preferences toward the two major AD options (i.e Living Will and Durable Power of Attorney) and what factors influence their preferences respectively.

The survey for this study was performed on the 13th of August to the 8th of September 2012. Permission for survey data collection came from a Senior Welfare Center located in Seoul and was approved from Institutional Review Board of College of Nursing, Seoul National University. Total 180 subjects, who met the inclusion criteria in this study, replied to a structured questionnaire with individual face-to-face interviews.

The questionnaires were composed of the perceptions and preferences regarding Living Will and Durable Power of Attorney, sociodemographic and health related factors, family function, and religious participation. Analyzing the data from this study using frequencies, percentages, mean, standard deviation, χ², t-test, and logistic regression analysis with SPSS WIN 20.0program and a P value <.05 was considered significant.

The major findings of the study were as follows:
First, the mean age of the participants was 73.56(±6.33)years
75.6% were female
43.9% educated under elementary school. Before participating in this study 76.7% of them had never perceived about Living Will and 83.3% had never heard Durable Power of Attorney. 7.2% had perceived the concept of Living Will and 5.6% had perceived the concept of Durable Power of Attorney exactly.

Second, after participants were informed of the concept of Living Will and Durable Power of Attorney, 49.4% of them preferred completion of a Living Will and 53.3% preferred designation of a Durable Power of Attorney. 31.7% preferred designation of both documents, 17.8% preferred designation of only a Living Will and 21.7% preferred designation of only a Durable Power of Attorney. 62.5% of them who wanted to execute a Durable Power of Attorney preferred their adult children as a proxy and 18.8% preferred their spouse as a proxy to make medical treatment decisions.

Third, a significant relationship with preferences toward Living Will was shown in regards to gender, level of education, a decision maker in the family, and monthly income. Male, higher levels of education, being as a decision maker in their family, and having over 500,000 won per monthly income were consistently associated with the preferences to Living Will. However, among health related factors, family function, and religious participation, they showed no significant relationship with preferences toward Living Will.

Fourth, religion, frequency of contacts with adult children, monthly income, how to pay minor health expenditure and major health expenditure, number of medical service use per 1 month, and family function turned out to be factors related to preferences toward Durable Power of Attorney. Participants having no religion, over 1 time per month in regards to contact with their adult children, over 500,000 won per monthly income, getting family assistance in regards to health expenditures, a lower rate of visiting medical institutions, and better family function were consistently associated with the preferences to Durable Power of Attorney. However, there was no significant influence on preferences toward Durable Power of Attorney by religious participation.

In this study, there were differences in the preferences and related factors of Korean elders towards Living Will and Durable Power of Attorney respectively. Family function was related to only Durable Power of Attorney while religious participation was not associated with the preferences toward both Living Will and Durable Power of Attorney, which was contrary to the results of previous studies. We need to investigate further studies for identifying the relationships among them.
