dc.description.abstract1994 기본합의(Agreed Framework)는 패키지딜로 구성되어 있어 북한과 미국 주도 하의 컨소시엄이 상호적으로 작용하여 단편적인 프로세스를 순차적으로 수행하도록 계획되어 있다. 기본합의의 공식적인 당사자는 미국과 북한 두 국가였으나 남한, 일본, 유럽연합 역시 기본합의에 큰 관심을 가진 주요 행위자였다. 즉, 이 모든 국가들이 기본합의에 있어 각국만의 특색있는 영향력을 미치고 있었으며, 또 그들만의 개인적인 이유를 가지고 기본합의에 임했다. 결과적으로 그 합의는 모든 참여국들이 냉전 후 국제정세에서 새로운 이해관계를 추구하게 되는 흔치 않은 기회를 제공함에 있어 엄청난 잠재력을 가져다 주었던 것이다.

그러나 합의의 진행이 좌절되자 당국자들은 당황했고, 기본합의가 실패로 돌아가게 된 이유에 대한 추측이 난무했다. 이제까지 여러 가지 설명이 있어 왔지만, 크게 두 가지의 대립되는 견해로 구분되었다. 첫 번째 견해는 기본합의의 실패 원인을 북한의 불법적 핵무기 개발 시도로 보고 있고, 다른 한 견해는 기본합의의 실패 원인이 북한의 핵 보유 및 추구가 아니라 미국의 비우호적인 대북정책이 오히려 북한의 핵 개발 의지를 부추겼다고 주장한다. 그러나 두 가지 견해 모두 타당한 주장임에도 불구하고, 각 견해는 기본합의가 궁극적으로 실패한 이유를 완벽하게 설명하지 못한다. 양 극단에 서있는 두 주장은 기본합의가 실패한 이유를 상호적으로 설명할 수 없기 때문이다.

본 연구는 기존에 논의된 두 개의 상반된 주장간의 공통점을 찾아내고 기본합의가 궁극적으로 실패한 원인을 규명하고자 한다. 본 연구는 상반되는 두 견해가 가지는 두 가지 공통점(첫 번째 공통점은 두 논점이 기본합의 조항 자체를 논거로 사용했다는 점이고, 두 번째 공통점은 합의에서의 이탈자가 발생한 것은 애초에 방지할 수 있었다는 것)을 분석했다. 그리고 분석을 통해 기본합의가 실패한 이유를 합의 자체의 구조적인 문제에서 찾는다. 즉, 기본합의의 구조가 한 두 가지 협약과정에서 발생할 수 있는 차질을 완벽히 극복할 수 없는 구조라는 점에서 기본합의의 실패를 설명하고자 한다. 기본합의의 구조를 찬찬히 살펴보면 그 것을 확인할 수 있다.

다자협약임에도 불구하고 기본합의는 여러 개의 양자조약이 겹쳐진 형태를 띄고 있어 당사자들 간의 교류나 협력을 어렵게 한다. 이러한 구조 하에 어느 한 참여국의 변절은 협약의 핵심적인 거래에 차질을 빚을 수 있기 때문에, 전체적으로 협약을 성사시키는데 어려움이 있다. 기본합의의 구조는 당사국들이 각자의 책임을 다해야 하는 수평적 구조로 되어있기 때문에, 어느 한 당사국으로 인해 합의의 차질이 생기는 경우, 타 당사국들은 각자의 책임을 다하지 못했다. 그러나 기본합의의 특수한 구조는 참여국의 변절로 인한 차질이 반복적으로 발생할 수 있다는 사실을 감지하지 못했다. 각 참여국들의 국내 문제들이 장애요인이 되어 전체적인 합의점을 찾는데 기여하지 못한 것에 책임이 있을 뿐만 아니라, 각기 다른 협상논리를 갖게한 외부 요인에도 책임이 있다. 협약의 장기적인 시간 프레임 또한 협약의 구조적인 문제를 더욱 드러내 보였다.

게다가, 기본합의의 구조적인 난관은 거래파기와 같은 위협을 극복하기에는 무력했다. 일반적으로 '다자간 패키지딜'은 참여국에의해 간헐적으로 발생할 수 있는 실패를 어느 정도 보완할 수 있다. 협의 구조 내의 다른 협약에서 보여지는 진척이 탈당자들을 보다 더 크고 총체적인 이득을 얻기 위해서라도 돌아올 수 있도록 유인하기 때문이다. 그러나, 협의 내 다양한 거래 처리과정에 있어 지속적인 진척 없이는, 잠재적 거래파괴자들에게 총체적인 협약으로부터 얻을 수 있는 이익을 보존시키기 위해 단기적인 각국의 이익을 포기할 것을 설득하는 것은 무효하다. 2006년에 KEDO를 통한 제네바 협의 해체 결정이 그 사실을 입증한다. 기본합의는 전에 다른 협약으로부터의 긍정적인 여파로 몇 가지 문제를 해결했지만, 궁극적으로는2002에 불거진 북한의 고농축우라늄 문제는 극복하지 못했다. 당시 이 협약을 끝까지 성사시키기 고자 하는 참여국들의 동기부여가 매우 적었다. 그 이유는 광범위한 교착상태로 인해 기본합의가 의도한 최종목표에 도달할 것이라는 조짐이 거의 보이지 않았기 때문이다. 제네바 협의는 교착상태의 발생을 예상하였지만, 그 강도와 빈도를 과소평가했다.

dc.description.abstractThe 1994 Agreed Framework was a package-deal that was designed to have its many components reciprocated through a piecemeal implementation process between North Korea on one side and a U.S.-led consortium of members on the other side. Although the U.S. and North Korea were the only two signatories on paper, South Korea, Japan and the EU were also major players with high stakes in the deal. In other words, each of these countries secured a high of degree influence in the Agreed Framework in their own unique way and for their own personal reasons. Consequently, the deal was regarded to have tremendous potential for each of its participants since it provided everyone with a rare opportunity to pursue many of their respective interests in the post-Cold War era.

Many officials were thus disconcerted when the progress of the deal collapsed, leaving many to speculate as to why the Agreed Framework ultimately failed. Although the existing explanations vary, they are primarily divided between two opposing views. While one view argues that the Agreed Framework failed due to North Koreas illicit attempt to secretly develop nuclear weapons grade materials during the deals implementation process, the other view posits that the Agreed Framework failed because the North was induced to preserve its nuclear capabilities due to American negligence and hostility. Although both views raise valid arguments, they individually do not provide a sufficient explanation for why the Agreed Framework ultimately failed. This is because their polar relationship makes it is difficult to identify a causal explanation for why the deal failed without it getting undercut by at least one of the two views.

This thesis attempts to construct a common ground view between the two existing camps that could explain why the Agreed Framework ultimately failed. After first identifying two core commonalities between the two existing views (one being that both views base their reasoning on the official stipulations of the Agreed Framework and the other being that they both believe that each of their alleged culprits violations during the deal were initially rectifiable), this thesis constructs a middle ground view which argues that the Agreed Framework failed because the deals ability to reach its desired endgame was structurally infeasible. A closer look at the deals structural makeup reveals that the Agreed Framework had many structural challenges that restricted its ability to succeed.

Despite being a multilateral agreement, the Agreed Framework was essentially structured as an interlocked web of bilateral agreements that precluded the players from being able to compensate for one another. This was a huge challenge to the deal because a defection by a player would have resulted in a suspension in one of the deals core transactions. Such a suspension would have undercut the ability of the other players to fulfill their designated requirements because the deals transaction structure necessitated its tasks to be implemented in parallel. However, the Agreed Frameworks specific design left it susceptible to reoccurring setbacks due to frequent player defections. Not only were the players liable to fall short of their contributions due to domestic hindrances, but also due to external factors that affected each of their bargaining logic in different ways. The deals lengthy time frame also gave the deals structural challenges more opportunities to manifest themselves.

Moreover, the structural challenges of the Agreed Framework made it less capable of overcoming a setback that threatened to break the deal. Multilateral package-deals are generally more capable of enduring intermittent setbacks caused by player defections since progress made in the deals other transactions induce defectors to return for the sake of acquiring a greater overall gain. However, without consistent progress being made in the deals various transactions, the greater incentive needed to convince potential deal-breakers to endure a short-term loss for the sake of preserving the overall deal would be void. Ultimately, this is what occurred when the Agreed Framework via KEDO decided to disband in May 2006. Although the Agreed Framework had previously overcome several setbacks due to positive spillovers from the deals other transactions, the agreement was ultimately unable to overcome North Koreas HEU issue in 2002. The players during this period had little incentive to stay in the deal because there was little indication that the deal would reach its intended endgame due to wide-ranging stalemates that had transpired at the time. The Agreed Framework anticipated that stalemates would occur, but the deals structure greatly underestimated their strength and frequency.
