북한 해양법 연구

Abstract

2018년 북한의 국제적 고립 탈피를 위한 유례없는 행보로 세계는 한반도에 이목을 집중하고 있다. 특히, 남․북 간 군사적 긴장완화와 전쟁위험 해소를 위해 상대방에 대한 모든 적대행위 전면 중지, 서해에 평화수역 조성, 안전어로 보장 등이 언급되었다. 한편, 1982년 유엔해양법협약 채택으로 연안국들은 국가의 사활적 이익과 직결되는 해양관할권 확대 및 유지를 위해 노력하고 있다. 향후 남・북 관계 개선에 따른 해양에서의 인적․물적 교류 확대 시 원활한 협력 및 상호 발전적인 정책대안 마련 및 주변국들과 분쟁 발생 시 남․북 공동 대응을 위해 해양관할권에 관한 북한의 태도에 대해 면밀한 검토가 필요한 시기이다. 본 연구에서는 현재 북한이 해양관할권에 대해 보이고 있는 태도의 특징을 분석해 본 결과, 북한은 유엔해양법협약 수용 시에는 정치 이데올로기라는 내부적 요인의 영향을 받아 자국을 중심으로 한 이상적 안보를 추구하고, 그 양상은 여느 약소국과 다르게 능동적이고 독창적이었다. 한편, 대외적으로 관련입장 표명 시는 타국과 직접적인 충돌을 피하고 희생을 최소화하기 위해 강대국의 입장에 편승하거나 주변국이 취하는 입장을 살피는 등 주변정세의 영향을 받아 현실적 안보이익을 추구하며, 그 양상은 수동적이고 전형적인 약소국의 행태를 보였다. 이로써 우리는 향후 북한과 해양에서의 교류․협력 시 북한의 이러한 이중적 태도를 고려하여 전략적인 정책대안을 마련해야 할 것이다. 또한 해양에서의 협력과 해양관할권 관련 남․북한 공동대응을 위해 유엔해양법협약을 기반으로 한 동일한 해양법체계 마련이 필요하다. 또한 과거 제로-섬 게임이었던 남․북 관계가 상생, 공영을 위한 윈-윈 전략으로의 전환이 필요한 시기이다. 그러므로 상대방의 해양관할권에 대한 태도 등을 학습하고, 협력을 준비하기 위해 남․북 간 상호 학술적 교류가 활발히 진행되어야 할 것이다.

On the other hand, the adoption of the UNCLOS in 1982 has made efforts to expand and maintain the maritime jurisdiction directly linked to the national interests. North Korea's attitude toward the maritime jurisdiction should be carefully examined in order to facilitate smooth cooperation and mutual development of policy alternatives in the future when the South-North relationship improves, It is time to review. In this study, we analyzed the characteristics of attitude toward the maritime jurisdiction in North Korea. As a result, when North Korea accepts the UNCLOS, it pursues ideal security centering on its own country under the influence of internal factors such as political ideology, Unlike any weaker country, was active and original. On the other hand, in expressing related positions outside the country, pursuing realistic security interests by influencing the surrounding situation, such as hopping a powerful country or taking a position of neighboring countries in order to avoid direct conflict with other countries and minimize sacrifice, And the behavior of the typical weak countries. Therefore, we should prepare strategic policy alternatives in consideration of this dual attitude of North Korea in future exchanges and cooperation at the sea with the North. It is also necessary to establish the same legal system of the sea based on the UNCLOS. In addition, the South-North relationship, which had been a zero-sum game in the past, is a time of need for a win-win strategy for coexistence and co-prosperity. Therefore, mutual academic exchanges should be actively conducted between the two countries in order to learn the other's attitude toward maritime jurisdiction and prepare for cooperation.
