소프트웨어 발명에 관한 기업의 지식 재산 전략

Abstract

This study analyzes the influence of intellectual property strategy on the innovation performance of companies related to software inventions. The software inventions are mainly used in the information and communication industry, and may be directly related to the software industry and partially related to the ICT manufacturing industry according to the Korean Standard Industry Classification (KSIC). This study analyzes effective intellectual property strategies for the software industry compared with the ICT manufacturing industry by dividing the cases where patent protection mechanisms and informal protection mechanisms are applied individually and in combination. Additionally, this study determines whether firm size has a moderating effect for each intellectual property strategy. The result shows that the combination of patent protection mechanisms and informal protection mechanisms has a positive effect on innovation performance in both the software industry and the ICT manufacturing industry. Meanwhile, the intellectual property strategy using only patent protection mechanisms has a positive effect on the innovation performance in the ICT manufacturing industry. However, in the software industry, the intellectual property strategy using only patent protection mechanisms has different effects on the innovation performance depending on the size of the company. In conclusion, the intellectual property strategy related to the software inventions is desirable to use both patent protection mechanisms and informal protection mechanisms. When only patent protection mechanisms are used, the type of the industry and the company size should be considered.

본 연구는 지식 재산 전략이 소프트웨어 발명에 관한 기업의 혁신 성과에 미치는 영향을 조사한다. 소프트웨어 발명은 정보 통신 산업에서 주로 이용되며, 한국표준산업분류(KSIC)에 따라 소프트웨어 산업과 직접적으로 관련될 수 있고, ICT 제조업에도 부분적으로 관련될 수 있다. 본 연구는 특허 보호 수단과 비공식적 보호 수단이 각각 개별 적용된 경우와 결합 적용된 경우를 나누어 소프트웨어 산업과, 이에 대비되는 ICT 제조업에 대해 유효한 지식 재산 전략을 분석한다. 추가적으로, 본 연구는 기업 규모가 각각의 지식 재산 전략에 대해 조절 효과가 있는지 확인한다. 분석 결과, 특허 보호 수단과 비공식적 보호 수단을 함께 사용한 경우, 소프트웨어 산업과 ICT 제조업 모두에서 혁신 성과에 긍정적인 영향을 미쳤다. 한편, 특허 보호 수단만 사용한 경우, ICT 제조업에서는 혁신 성과에 긍정적인 영향을 미쳤으나, 소프트웨어 산업에서는 기업 규모에 따라 혁신 성과에 미치는 영향이 상이했다. 결론적으로, 소프트웨어 발명의 지식 재산 전략은 특허 보호 수단과 비공식적 보호 수단을 함께 사용하는 것이 바람직하며, 특허 보호 수단만 사용할 경우 산업 유형과 기업 규모를 고려하여 결정해야 한다.
