There are two types of transactional arguments which justify individuals obligation to obey political authorities: the consent doctrine and the fairness arguments. The former justifies it through individuals giving express or tacit consent; the latter through reciprocating the benefits a political community offers. However, Simmons argues, for the former, that Locke confuses tacit consent with accepting benefits; for the latter, there are few who accept benefits and therefore, according to Simmons, both arguments do not apply to the legitimacy of political authority in contemporary political society. However, I argue that Simmons faces a critical problem. If he distinguishes the acceptance of benefits from the mere receipt of benefits according to his intention and knowledge conditions, the former becomes a sort of choice act and further is subsumed within tacit consent as a relational choice act. Therefore, the fairness arguments maintaining that political obligation arises without individuals consent lose their convincing force and hence are subsumed into the tacit doctrine. | - |
