숙의거버넌스와 합의형성 제도설계: 시화지역 지속가능발전협의회의 운영사례를 중심으로

Abstract

본 연구는 시화호 개발과정에서 운영된 시화지속가능발전협의회를 일종의 숙의기제로 파악하여, 대규모 국책사업에서 합의형성에 기여할 수 있는 숙의거버넌스(deliberative governance) 모델을 탐색하고 효과적인 제도 설계를 위한 함의를 제시하는 것을 목적으로 하였다. 개발과 보존의 이슈를 둘러싸고 이해 당사자간 첨예한 갈등의 경험과 학습을 통해 합의형성 기제를 제도화해 나갔다는 점에서 시화호 개발갈등사례는 유사한 갈등을 경험하였으나 그러하지 못했던 새만금사업이나 동강댐개발사업의 경험과 차별되는 특징을 보여준다. 숙의거버넌스가 가지는 의미는 단순히 민과 관이 함께 정책문제의 해결을 시도했다는 것에 의미를 부여하는 것이 아니라 민과 관이 어떠한 방식으로 문제를 해결해 나가는가 하는 가에 큰 그림을 제시해 주었고, 향후 개발과 보존 논리가 부딪치는 풀기 어려운 갈등 문제(wicked problem)에서 정책이해당사자들이 합의형성에 효과적으로 도달하기 위해서는 어떠한 방식으로 거버넌스가 작동되어야 하는가에 대한 본보기를 보여주고 있다는 점에서 시사점을 가진다. 숙의거버넌스는 거버넌스의 특징에 숙의라는 것이 추가된 것이지만 정책영역에서는 새로운 패러다임의 도래가능성을 보여주며, 무엇보다도 이러한 숙의거버넌스의 경험은 정책발전이라는 측면에서 깊은 의미를 부여할 수 있다. This study deals with the policy case of the Shihwa Lake Development Project as an exemplary case of a public policy conflict between development and conservation. It not only tries to explore a model of deliberative governance that helps to establish consensus building in the large-scale national policymaking process but also aims to suggest implications for effective institutional design. The Shihwa Lake development project was pretty similar to the cases of the Saemangeum development project and Dong River Dam project in that it underwent a sharp conflict over the issues of development and conservation between the interested parties. However, it separates itself from the two cases in that it transformed the conflict into consensus-building through experience and organizational learning. The significance of deliberative governance comes from the fact that it showed a general outline of how citizens and government can solve a policy problem, not from the simple fact that both tried to solve the policy problem together, and deliberative governance also gives important implications for how governance mechanisms should operate effectively to reach consensus-building to solve the wicked problems caused by conflicts between development and conservation values. Deliberative governance is a sort of governance colored with deliberation but opens the possibility of birth of a new policy paradigm. It has much value in the context of policy development as well.
