규제의 개념에 관한 소고

Abstract

규제에 대한 무수한 논의에도 그에 대한 실무적 혼동은 여전하다. '민간에 대한 행위의 제약'으로 간단히 정의되는 규제의 개념을 실제로 정부활동에 적용할 경우, 실무자에 따라 개념의 해석이 천차만별로 나타나기 때문이다. 이런 규제개념의 혼동은 체계적인 규제관리를 통해 규제의 품질을 높이는데 큰 걸림돌이 될 수 있다. 명백히 규제임에도 불구하고 관리대상에서 제외되는 등 규제관리의 허점이 초래될 수 있기 때문이다. 이런 규제의 개념에 대한 혼동을 정리하기 위해서는 규제를 형식이 아닌 속성으로 파악해야 한다. 그리고 필요성이 규제의 개념을 구성하는 토대가 될 수 없음도 명확하게 인식되어야 한다. 규제 개념의 핵심을 구성하는 강제성에 대한 해석에 있어서도 피규제자의 입장이 고려되어야 한다. 이런 경우 정부활동 중 국민들이 명시적으로 '해야만 하는 것'만이 아닌 '하지 않을 수 없는 것'도 규제에 포함하게 된다. 나아가 현실의 규제는 공식적인 것만을 일컫지 않으며, 정태적이지도 않다. 규제의 개념을 이렇게 파악할 경우, 정부활동 중 조세행정절차, 지원정책 프로그램, 행정내부규칙, 민상법 내 강행규정을 규제의 틀 속에서 다시 논의해 볼 수 된다. Although there have been many studies and reforms of regulations, the concept of regulation is still ambiguous. Due to this ambiguity, there are numerous difficulties in improving the quality of regulations. Some regulations are not included in governmental regulation management systems. Therefore, for the concept of regulation to be understood more clearly the following issues need to be discussed. First, a piece of regulation is not a law or article itself, so if a government policy program is labeled as a regulation, the focus must be on the coercive nature of the line. Second, we should not take the necessity of any lines as the base of the conceptualization of regulation. Third, the interpretation of the concept of the cerciveness should not only be based on 'have to' but also on 'have no choice but do.' Grasping the concept of regulation, as in this study, can be can found that taxes, governmental support programs, and administrative guidelines could be considered as regulations if there are some coercive traits.
