재산권 이론의 정책학적 기여에 관한 소고(小考): 이론적 함의를 중심으로

Abstract

재산권과 거래비용은 사실상 정책의 거의 모든 영역을 설명하는 데 활용될 수 있다. 그럼에도 불구하고 정책학 연구에서는 재산권을 너무나도 당연한 것으로 간주하여 재산권 이론을 이해하고 재해석하며 그 개념을 분석적 수준으로 받아들이려는 노력이 부진하였던 것이 사실이다. 본 연구에서는 이런 문제의식을 다음과 같은 세가지 논점을 중심으로 전개하여 재산권 측면에서 정책 형상을 검토할 때 야기될 수 있는 정책연구의 과제를 제시해 보았다. 첫째, 재산권 이론의 개념과 발전과정이 제도나 이념의 형성과 발전과정에 어떤 관계가 있으며, 정부의 역할은 어떻게 정의될 수 있는가? 둘째, 재산권 이론의 접근방법은 어떤 현상을 설명할 때 다른 이론적 접근방법이 제공하지 못하는 현상을 설명할 수 있는 장점을 갖는가? 셋째, 재산권 이론의 접근방법을 활용하면 정책학 이론의 의연은 어떻게 확장되는 것이며, 사회현상의 분석 수준은 어떻게 깊어지는 것인가? 이론적 검토 결과 재산권 이론은 정책학의 이론적 가정에서 시작하여 정책연구의 개별영역, 설명하기 어려웠던 정책연구의 이론적 문제들, 아직 시도되지 않은 설명영역들에 대한 새로운 접근 방법을 제시하고 있다고 볼 수 있다. 재산권 연구의 철학적, 방법론적 특징을 받아들이는 노력은 그동안 처방적 연구에 치중하던 정책학 연구의 이론적 지평을 넓히고 정책현장의 이해를 돕는데 상당한 기여를 제공할 것으로 보인다. Property rights and transaction cost approach is very useful and applicable to almost all policy studies. But we could hardly find the meaningful results using these compact and powerful theoretical concepts in korean policy studies. In this article, trials revisit the meanings of property rights in policy studies are done from the perspectives as below. First, What is the basic concept of the property rights and how did those concepts are evolved and developed? Second, Which policy area of the real world is best to exhibit the usefulness of property rights approach? Third, To what extent is it possible furthering and enlarging policy studies in explaining the social phenomena by applying the concepts? Theoretical review in this article shows that the concepts are very powerful in the area of research on theoretical basis of policy studies like policy conflict, opportunistic behavior of actors in policy implementation process, explaining the reasons of self-enforcement, the evolution of co-operation etc.
