인도의 대표관료제 정책 연구: 적극적 조치 정책의 집행을 중심으로 : Indian Representative Bureaucracy and Affirmative Action

- Abstract
- 인도는 공직의 대표성을 확보하기 위하여 독립 이후 지정 카스트, 지정부족 및 여타 후진계급에게 신규 채용과 승진에 있어서 49.5%를 할당하고 있다. 그러나 정책을 실시한지 약 60여년이 지나고 있지만 그 효과는 제한적이다. 본 연구는 정책집행과정에 어떠한 요인이 이러한 결과를 가져왔는가를 분석하는데 주목적을 두고 있다. 이를 위하여 인도의 적극적 조치 정책을 목표, 대상 집단, 수단이라는 구조적인 특성을 살펴보고, 여러 학자들이 제시하고 있는 정책집행에 영향을 미치는 요인을 정책변수, 집행변수, 문제의 성격, 환경적 변수로 분류하여 분석하였다. 분석결과에 의하면 적극적 조치가 권위적 차원에서 헌법에 근거하고, 지배집단 및 정치적 요인에 의하여 부분적인 성과를 가져오는 데 기여하였다. 그러나 다원적인 정책목표, 이행을 강제할 수 있는 메커니즘의 결여, 담당자의 무관심, 다수를 대상으로 다양한 행태변화를 요구하는 문제의 특성, 제한된 집행 수단, 높은 빈곤율 등은 집행의 효과성을 떨어뜨리고 지연시키는 요인으로 지적되었다. The Constitution of India enables the state to make provision for the reservation of appointments or posts in favour of any backward class of citizens that is not adequately represented in the services of the state. Indian government and law provides for a quota system whereby a 49.5 per cent of posts are reserved for scheduled castes (SC), scheduled tribes (ST), and other backward classes (OBC). After 60 years of affirmative action policies, little improvement can be seen for SCs, STs, and OBCs. Why have preferential treatment policies failed to reach their goals? This article describes India`s reservation policy structure-the policy goals, target groups, and policy tools-and aims to analyze the variables that affect the implementation of reservation policy. This article points to the relevance of policy variables, enforcement activities, characteristics of implementing agencies, contextual variables, and the characteristics of policy problems. In particular, the crucial variables affecting the achievement of reservation policy goals are multiple policy goals, the absence of enforcement of legal obligations, the inequity and apathy of agency staff, the large size of the target group, limited policy tools, and the poverty of SCs, STs and OBCs.
