장애인 정책의 사회적 구성: 장애인차별금지법 제정 사례를 중심으로

Abstract

본 연구는 사회적 구성주의 시각에서 한국사회의 대표적 소수자인 장애인의 정체성 변화를 고찰하고, 정체성 변화에 영향을 미치는 요인을 분석하여 장애인차별금지법이 제정될 수 있었던 배경을 탐색하였다. 정체성 변화에 영향을 미치는 변수는 정부 관련성(정부 관련성 높음/정부 관련성 낮음), 영향력을 미치는 부분(인식/인식·권력/권력)을 기준으로 구분하여 분석하였다. 분석 결과 장애인의 정체성은 1980년대까지 일탈집단에 머물렀으나 1990년대 후반, 2000년대 초 의존집단으로 변화되었고 2000년대 후반인 현재 수혜집단으로 변화되는 과정인 것으로 나타났다. 장애인차별금지법은 장애인의 정체성이 수혜집단으로 변화되는 과정에 나타난 결과로 분석되었다. 한편 정체성 변화에 영향을 미친 요인을 살펴보면, 인식의 전환에는 정부와 관련된 요인으로 정책설계가, 정부와의 관련성이 낮은 요인으로 사회운동, 사회적 사건 등이 영향을 미치는 것으로 나타났다. 이와 함께 권력 측면에 영향을 미치는 변수로는 정부와 관련이 높은 요인으로 정치적 사건과 정책설계, 외부적 사건을 정부 관련성이 낮은 변수로는 사회운동의 영향을 확인할 수 있었다. 본 연구를 통해 장애인의 권익이 지속적으로 향상되고 있지만 아직 한계가 없는 것은 아니며, 정책설계의 영향력을 고려할 때 장애인의 자립생활 및 권익 확보를 위한 다양한 시도가 지속적으로 이루어져야 할 것이다. This study reflects on changes in the identity of the disabled, a representative minority in Korean society, from the perspective of social constructivism, and analyzes the factors that have influenced this change in order to examine the background to the passage of the Anti-Discrimination against and Remedies for Persons with Disabilities Act. The factors that have influenced the change in identity were analyzed based on the categorization of the strength of their relation to the government (highly related to the government/less related to the government) and the aspects that exert influence (perception/perception·power/power). The analysis showed that the identity of the disabled remained as "deviant" until the 1980s but changed into that of "dependent" in the late 1990s and early 2000s, and is currently in the process of turning into that of "advantaged group" in the late 2000s. The Anti-Discrimination against and Remedies for Persons with Disabilities Act was also determined to have resulted from the process of changing the identity of the disabled to advantaged group. Meanwhile, when looking at the factors that influenced the identity change, it was found that the paradigm shift was influenced by policy design, as a government-related factor, and social movements and social incidents as factors with less relation to the government. Furthermore, the variables that influenced power were identified as, on the one hand as highly related to government, political incidents, policy design, and external incidents and on the other as social movements that were less related to government. Although this study has found that the rights and interests of the disabled keep being enhanced, there still remain limitations when considering the influence of policy design. In this regard, various attempts should be taken consistently to secure self-reliance as well as the rights and interests of the disabled.
