강간의 정의: 재미한인여성들의 사유(思惟)

Abstract

본 연구는 이와 같은 사회구성주의(social constructivism)적 연구입장 안에서 강간이라는 것을 특정한 사회문화적 맥락 안에서 그 실재가 구성되는 행동범주로 정의하고, 미국 내 아시안 계 소수민족 집단중의 하나인 한인여성들을 대상으로 이들이 강간을 정의하는 방식과 그 맥락에 대해 살펴본다. 특히 이들 여성의 강간 정의가 이루어지는 방식과 맥락을 종족성 및 성 인지적 관점(ethnic gender perspective)에서 분석한다. 여기서 종족성 및 성인지적 관점이란 소수민족 여성들의 성폭력 경험 또는 이에 대한 태도들을 그들의 시각에서, 그들이 경험하는 차별적 성관계와 관련하여, 특히 그러한 차별적 성관계의 형성, 유지에 영향을 주는 종족 적 문화양식의 특수성이나 그 여성들의 종족적 지위와 관련하여 설명하는 일반적인 접근방법을 지칭한다(이종인 2006). 이러한 접근방법을 취하는 것은 여성주체, 특히 소수민족여성 주체의 관점에서 강간을 파악한다는 점에서 의의가 있다.

본 연구가 재미한인여성들에 초점을 맞추고 이들의 강간 정의 방식을 살펴보려는 이유는 미국 내 아시안 계 여성들의 강간 사건피해경험의 보고율이 다른 종족집단의 여성들에 비해서 상대적으로 저조함에도 불구하고 아시안 계 여성들의 강간사건이나 강간사건 폭로에 대한 관점이나 생각들에 관한 연구들이 거의 없기 때문이다(Lee 2003). 또한 같은 아시안 계 여성이라고 할지라도 그 출신 문화배경이 다름으로 해서 강간이나 강간사건 폭로에 대한 생각이 다를 수 있으므로, 각각의 아시안계 여성 집단에 초점을 맞추는 개별 연구를 통한 경험적 자료의 축적이 다양한 종족집단 여성들의 강간의 개념을 비교하기 위한 사전작업으로서 중요하다고 생각하기 때문이다.

Defining rape as a social construct, this study explores the way in which Korean American women define the concept of rape, and the socio-cultural contexts within which their definitions of rape are situated.

First, the study examines the way in which women narrate about the concept and the cases of rape, focusing on the criteria used in their definitions of rape. Second, it discusses the characteristics and production mechanisms of the sexual beliefs among Korean American women. The research for this study w as conducted from an ethnic gender perspective.

Its perspective emphasizes the important roles of the sexual power differentials between a man and a woman as well as ethnic women's perspectives in the construct of rape. Data for the research were collected from face to face interviews with 36 Korean American women as well as from surveys with 219 Korean American women. The data collection was conducted between 1994 and 2000 in the New England area.

The in-depth interview data reveal that the four criteria the w omen use in determining whether a certain sexual encounter constitutes a rape are: a) sexual behavior involved b) a woman's consent (or dissent) to sex c) an emotional dimension, including a man's motivation for sex and a woman's feeling about sex (e. g. 'shame' or 'insult'), and d) the relationship between partners.
