| dc.description.abstract | Hans Kelsen의 法理論에 대해 제약된 시간에서 講演한다는 것은 그것이 근 90년에 걸쳐 여러 학자들의 寄與와 많은 二次(硏究)文獻을 통해 발전된 매우 擴張된 理論이기에 나에게는 어렵고 힘든 과제이다. 그래서 理論의 樣態와 그 背景에 대해 약간 언급하고 몇 개의 特徵的인 立場들을 소개하는데 그칠 수밖에 없다. Hans Kelsen의 법이론은 - 純粹法學이라고 하는데 - 實定法이라는 대상에 대한 科學的인, 즉 客觀的인 - 間主觀的으로 檢討 가능한 - 考察을 기하기 위한 하나의 프로그램이다. 이는 實定法 도그마틱의 一般理論이라고 규정될 수 있다. 이러한 규정은 여러 점에서 좀더 자세한 설명이 필요하다. | - |
