국회의 의사진행 및 의사소통: 현실, 문제, 대책

Abstract

국회는 끊임없는 정보교류와 의사소통을 필요로 한다. 특히 사회의 다양한 이익과 가치를 대변하는 정파들이 서로 타협 · 합의하는 곳이라는 점에서 의사소통의 중요성은 더욱 크다. 그런데 국회 의사소통의 실제는 대내 대외 모두에서 긍정적이지 못하다. 먼저 대국민 의사소통의 장애는 종종 국회를 먼 섬나라 로 변질시키는 결과를 낳았다. 17 대 국회의 4 대 개혁입법 논란은 오히려 국민적 반감을 낳았고， 시의성 면에서도 관심 밖 사안이었다. 그래서 국회는 국민들에게 저들만의 파워게임에 몰두해 있는 전형적인 정치계급 모습으로만 비춰졌다. 국회 내 의사소통의 장애는 소위 파행을 가져온다. 17 대 국회의 경우， 파행은 오히려 더 심해진 경향을 보였다 .2004년 4대 개혁입법 문제로 파행을 거듭한데 이어 2005 년 12월에도 사학법 강행처리로 국회는 53 일 간이나 파행을 지속했다. 국회파행은 대화와 타협으로 합의에 이르지 못한 경우에 발생한다는 점에서 의사진행의 문제로 이해할 수 있다. 의사진행의 문제는 본회의， 상임회의， 소회의， 대정부질문， 국정감사 등에서 비효율적·폐쇄적 진행행태와 중복된 혹은 비합리적인 절차 · 형식 등에서부터 강압적인 '날치기' 처리에 이르기까지 다양하다. 국회 내 의사진행상의 문제는 절차와 기술의 문제 외에 의원 간의 왜곡된 의사소통 행태와도 밀접히 연관되어 있다. 논의전개를 방해하는 말 끊기나 끼어들기 , 비어나 속어， 근거 없는 의혹 제기， 인신공격， 흑백논리， 약정질문 등의 왜곡된 발언을 통해 합리적 의사진행을 어렵게 만들기 때문이다. 의원들의 왜곡된 의사소통 행태는 단순히 개인적 자질 뿐만 아니라， 국회 자율성 여부에도 원인이 있다. 이들은 청와대， 소속정당 그리고 지역구민 · 이익단체로부터 영향을 받는다. 따라서 우리가 국회 의사진행과 의사소통의 문제를 개선하려 든다면， 세 가지 차원에서의 접근이 필요하다. 첫째는 국회 내 모든 회의의 의사진행과 관련된 법규나 절차들을 보완하는 일이며， 둘째는 의원 개개인들의 의사소통 능력을 개선하는 일고， 셋째는 국회의 자율성을 제고할 수 있는 방안을 세우는 일이다. 이런 기술적 · 구조적 차원의 대책을 통해 궁극에는 국회 내 의사소통과 의사절차가 최적의 공동의사 결정 에 도달할 수 있도록 해야한다.

Parliament, as the highest national instance of negotiation, compromise and control of different social and party interests, needs constant internal and external communication. However, the realities of such parliamentary communication in South Korea cannot be positively considered. In mass media, it is often called a far staying island from the nation. Above all, the debate on 4 reform laws in this legislative period has not roused interest, but rather antagonistic feelings among most people. After passage of the Korean Private Schools Law in lightning manner and in absence of the opposition party, the national assembly had no more parliamentary meetings for 53 days from December 8, 2005 to February 1, 2006, thereby delaying deliberation on other pressing bills. The National Assembly is considered to be a typical political class concentrated on their own political power games. The politicians isolation comes from internal hindrance as well, with procedural hindrance from modεrating and communicating plenum or committee meetings. If a controversial bill cannot be regularly or numerically passed or refused, the minority group makes any further procedure impossible by physically interfering. There are also serious problems of irrational acts and regulations regarding parliamentary moderating and communicating. To make matters worse, most Assemblymen do not have refined dialog nor communication skills. They often make obstructive comments both intentionally and unintentionally, for example, cutting each other off or snatching away anothers speech, bringing up groundless rumors, throwing insults, and so on. They also make no further orderly procedures. Three ways of resolving these problems of parliamentary internal communication and moderation are to revise related acts and laws, improve debate and moderating capacity of Assemblymen, and increase autonomy away from the Chief Executive, the President.
