한국의 권력구조 변화의 원인 분석

Abstract

본 연구의 목적은 한국에서의 권력구조 선택과 변화의 원인을 분석하는 것이다. 본 연구에서는 1948년 제헌의회에서 채택한 대통령제 정부형태와 제2공화국에서의 의원내각제로의 변화, 다시 1961년 5 . 16 군사쿠데타로 인한 제3공화국에서의 대통령제로의 복귀 과정에 초점을 두고 어떠한 상황에서 누가 어떠한 목적을 위해 어떻게 권력구조의 선택과 변화를 주도했는지를 분석하였다. 분석 결과에 따르면 한국에서의 권력구조의 선택에는 정치행위자의 정치적 목적이 중요한 요인으로 자리 잡고 있었다. 특히 정치적 영향력이 높은 정치권력자의 의도가 중요하게 작용하였다. 정치권력자들은 자신들의 정치권력을 획득하고 유지하기 위하여 그리고 야당은 새로운 권력구조 하에서 자신들의 정치적 생존을 위하여 정치 권력자와 타협하는 모습을 보여 주었다. 그리고 이러한 권력구조의 변화가 일어날 수 있었던 상황요인으로는 정치적 불안정과 4 . 19 혁명과 5 . 16 군사쿠데타와 같은 정치적사건 그리고 정치제도의 미성숙과 대안 세력의 부재 같은 요인들이 작용하였다.

The purpose of this study is to examine the cause of choices and changes of constitutional design in Korea by analysing who, under what circumstances, and for what purpose, by using what methods led the selection and change of the constifutioinal design. This study focuses on three consecutive events associated with changes of the constitutional designs which are the following the presidential system selected in the Constitutional Assembly in 1948, the transtition into parliamentary system by the Second Republic in 1960, and the return to the presidential system by the Third Republic in 1961. Based on case studies, this study intends to explore the common source that characterize changes of Koreas constitutional design and to find political implications for arguments about constitutional design change which has been in progress since. The findings suggest that the political goals and strategies of political actors play a pivotal role in their choice of constitutional design. Government party leaders wanted to achieve political power and maintain it by changing the constitutional design while opposition party leaders, for their political survival, compromised with power elites created under the new power structure. In addition, the change of the constitutional design took place under certain contexts that include political instability, political events, such as the 4 . 19 student evolution and the 5 . 16 military revolution, prematured political institutions, and the lack of alternatives.
