WTO와 시장통합, 정부규제의 변화: 세계화가 국가주권에 미치는 영향을 둘러싼 논의를 중심으로

Abstract

글로벌화의 영향에 대한 논란의 한 중심에는 국가주권의 문제가 위치하고 있다. 글로벌화의 폐해를 주장하는 논자들은 글로벌 시장통합으로 각국에서 자국 경제와 국내시장에 미치는 중앙 정부의 역할이 크게 제한되는 경제적 주권의 위축이 불가피하게 나타나고, 이것이 글로벌화 폐해의 궁극적인 요인인 것으로 설명한다. 글로벌화를 경제적 주권의 위축에 연계시키는 논의는 한편으로 초국적 기업의 영향력을, 다른 한편으로 WTO 등의 초국가 기구의 역할을 주요 설명 변수로 삼는다. 이 논문은 WTO의 경쟁정책의 다자규범화 실패사례 분석, 그리고 환경 정책 관련 다자규범의 성격 규명을 통해서 WTO는 국경선 위에서 작동하는 정책영역에서와는 달리, 국경선 안에서의 정책 사안들에 대해서는 각국의 국가주권을 제약하는 데에는 뚜렷한 한계를 갖는다는 점을 밝히고 있다. Does globalization limit the role of national government over national economy, and has shrunken national sovereignty gradually? The arguments about the effect of globalization are centered on either the power of transnational corporations or the expanding role of international economic organizations such as WTO and IMF. This article tried to show the WTO's limited authority as a transnational organization which restrains the national sovereignty of the member states. By analysing the failed attempts of multilateral agreements in the competition policy area and the traits of environmental multilateral agreements, this study asserts that although the WTO has tried to set up the multilateral rule 'behind the borderline', the national sovereignty of each state is still working over its market and economy.
