지방정부 규제행정의 성과요인에 관한 소고: 규제체감도를 중심으로

Abstract

본 연구는 규제행정의 기본적인 요소와 기업인들의 경험이 규제체감에 어떠한 영향을 미치는지 파악하기 위해 기업인 대상 설문자료를 구조방정식 모형을 통해 분석하였다. 분석결과, 규제 행정의 요인 중 단체장, 담당 공무원, 규제내용, 행정시스템 모두 기업인의 규제체감에 유의한 영향을 미치는 것으로 분석되었다. 기업의 특성변수로는 수도권 입지 여부만이 규제체감에 직접적인 영향을 미치는 것으로 나타났다. 특히 지방자치단체장의 경우, 행정경험을 매개변수로 포함한 모델서 가장 큰 영향을 미치는 변수로 나타났고, 담당 공무원은 두 번째로 높은 영향력을 미치는 것으로 나타나 기업인들의 규제체감에는 인적 요인이 큰 영향을 미치는 변수임을 알 수 있다. 한편, 행정경험 역시 규제체감에 직접적인 영향을 미치는 것으로 나타났고, 매개효과가 있는 것으로 분석되었다. 주요 시사점으로는 첫째, 기업인들의 규제체감에 직·간접적인 영향을 주는 행정경험을 개선하기 위한 자치단체장 및 공무원들의 노력이 더욱 경주되어야 할 필요가 있으며, 둘째 부당한 재량행위가 남용되지 않도록 행정절차 및 시스템 측면에서의 제도적 장치가 마련되어야 할 것이다. 마지막으로 개별 기업들의 특수성과 다양성을 반영할 수 있도록 규제 내용의 합리성을 제고하려는 노력이 필요하다.

This study analyzes how regulatory implementation factors and businessmens experiences impact their perceptions of the regulatory environment in South Korea using a structural equation model. The results show that regulatory implementation factors-local government head, public officials, contents of regulation, and administration system-have a significant effect on the perception of the regulatory environment. The characteristics of business, apart from regional factors, do not have a direct influence on the perceptions. In particular, local government head had the greatest impact on the dependent variable, followed by government officials as the second greatest factor. This suggests that human factors(local government head and officials) have a profound impact on how people doing business perceive the regulatory environment in South Korea. Meanwhile administrative experience had direct and indirect impact as a mediator on regulatory perception. The policy implications are: I) local government head and officials need to play a leading part to make a better regulatory environment as well as to settle improved systems and administrative processes that could prevent the abuse of power; ii) more responsiveness and flexibility are required for executing regulatory powers to deal with the diverse circumstances businessmen encounter.
