연방주의자 논고에 나타난 매디슨의 새로운 미국 국가: 광대한 공화국

Abstract

제임스 매디슨의 광대한 공화국론에 대한 이해는 먼저 그가 정부의 폭정과 구별되는 사회적 폭정을 발견하고 이에 대한 해법으로 연방정부의 창설이 필요함을 주장했다는 사실에서 출발해야 한다. 정부의 폭정과 구별되는 사회적 폭정은 바로 다수 분파에 의한 폭정이었으며, 이 문제는 영토를 넓히는 조치, 즉 광대한 공화국의 창설에 의해서 해결될 수 있었다. 그리고 이와 관련하여 매디슨은 최선의 대의정부(그가 정의하는 바 공화국)를 만들기 위해서 연합헌장체제내의 구성정부인 방가(邦家: state)의 경계를 초월하는 연방정부의 창설을 주장하였고, 이렇게 해서 창설된 정부가 정치적 폭정에 빠지지 않게 하기 위해서 권력분립의 필요성과 연방의 분권화를 주장하였다. 무엇보다도 사회적 폭정의 문제는 분파의 문제를 논의한『연방주의자 논고』10번에 지적되어 있으며, 방가 수준에서 이 문제의 해결은 어려우므로 연방이라는 광대한 영토와 인구를 통해 해결되어야 한다고 매디슨은 주장하였다. 광대한 영토 안에서는 다수 분파의 형성가능성이 어려워지고 잠재적 다수 분파가 생긴다 하여도 실재로 이를 실행하기가 어려울 것이라는 점이 매디슨 주장의 초점이었다. 이어서 그는 정치적 폭정은 연방정부 수립 이후 등장하는 문제로 이는 권력의 분립과 연방제도에 의해서 방지될 수 있다고 보았다. 이러한 매디슨의 견해는 반연방주의자들이 강력한 중앙정부에 대해서 품고 있었던 우려를 해소하기 위한 그의 반론으로서, 신생 공화국의 정부형태 안에는 권력의 집중에 대한 견제책이 마련되어 있음을 보여주기 위한 것이었다.

The key to a proper understanding of Madisonʼs argument on extended republic is to keep in mind that Madison distinguished two different types of tyranny, i.e., social and governmental. The former refers to majority tyranny, i.e., a tyranny caused by the majority faction in the society to augment its own interests at the expense of the interests of the rest of society. On the other hand, the governmental tyranny is the suppression of individual liberty by the concentrated power of the government. In The Federalist Papers, Madisonʼs solution to the problem of social tyranny was simply to extend the republic so that the interaction and balancing (or counter-balancing) of a variety of interests will result in social equilibrium with the majority factions wielding any power. In the eyes of Madison, the problem of factions in the American states during the late 18th century had been so serious that Madison believed the state legislatures to have been captured by the majority factions' interests of each state. According to Madison, the state lawmakers were virtually controlled by powerful factions in the state, and the legislative outcome was just tailored to favor their interests. Madison believed the solution to this problem to reside in extending the sphere of the nation so that it would be almost to impossible for a majority faction to congregate in the first place. Therefore, Madisons first and foremost objective in establishing an extended republic, i.e., a federal state, was to solve the problem of social tyranny. The problem of governmental tyranny, on the other hand, comes after the federal state is established. The anti-federalists, who strongly opposed the centralization of governmental power, were deeply concerned that the new federal government might encroach upon the states rights and citizens liberty. Madison, on his part, needed to address this concern for the new constitution of 1787 to be passed by each state assembly after the 1787 Philadelphia Convention. He, therefore, persuaded the anti-federalists by arguing that the separation of powers between federal branches and between the federal and the state governments will ensure the individual liberty of citizens, and state governments and will prevent the schemes of governmental tyranny.
