dc.description.abstract이 글은 자유인 매각 계약에 관하여 로마법과 전통 조선의 법을 비교한 것이다. 이 계약은 원래 자유인/良人이 스스로 매각되어 노예/노비가 되는 自賣계약을 가리키지만, 넓게는 근친, 특히 자녀, 배우자, 부모 등을 파는 것까지 그렇게 부른다. 또한 팔리는 자가 신분을 속이고 제3자를 매도인으로 삼아 스스로를 파는 계약유형도 있다. 로마법은 뒤의 두 유형을, 조선의 법은 앞의 두 유형을 알고 있었다. 우리나라에서는, 조선에 관한 한, 자유 신분의 상실이 갖는 중대성에도 불구하고 이 문제의 법적 측면에 관한 연구는 지금까지 이루어지지 않았다. 종래의 연구는 주로 사회사 내지 경제사의 관점에서 수행되었다. 自賣의 법률효과는 보통 팔린 자의 자손에게까지 미쳤다. 이러한 가혹한 효과는 관계당사자의 생존을 위한 것으로 묵인되었다. 로마와 조선의 상이한 법적 규율은 어떤 점에서는 로마의 노예와 조선의 노비가 상이한 법적 지위를 가졌던 것에 기인한다. 노예는 거의 물건이었고, 권리주체성이 부인되었다. 반면에 노비는 양인과 별반 차이가 없이 재산법 및 가족법상 권리가 인정되었다. 그리하여 로마법이 조선의 법보다 自賣계약을 용인하는 데 더 엄격했던 것 같다. 그렇지만 이런 차이만으로 두 법체계의 상이한 태도를 다 설명할 수는 없다. 로마의 법문화는 자유 존중이라는 법인간학의 기본적 관점을 견지한 채 법적 관점에서 세부적인 규율을 하는 경향이 있었다. 조선의 법은 국가도 극복하기 힘들었던 불가피한 물질적 곤경이라는 당시의 현실 조건에 양보했고, 대기근으로 유발된 내키지 않는 일련의 정책 속에서 自賣계약을 인정하였다. 법적 논변은 우선적인 것이 아니었고, 오히려 흔히 효도의 가치를 강조함으로써 自賣행위의 도덕적 정당화가 전면에 등장하였다. 팔린 자의 처지는 조선왕조 마지막 시기까지 매우 취약했고, 그 결과 19세기 말 내려진 고종의 自賣노비 보호를 위한 개혁조치에서도 여전히 소유주의 이익보다 뒷전이었다. 로마와 조선의 비교는 일방 기아와 같은 큰 재앙은 누구든 자신의 자유를 생존을 위하여 포기하도록 할 수 있는 인간조건에 속한다는 사실과, 타방 한 법질서는 언제나 필연적으로 미흡한 해결책을 제시하고, 변화하는 현실에의 대응에 있어서 부단히 변해간다는 사실을 잘 보여준다. 법질서의 이러한 대응은 그 자체의 법인간학에 의하여 근본적으로 영향을 받는다. 법학방법론은 항상 인간 삶의 현실 인자들을 고려하고 또 재고려해야 하며, 그 법질서의 법인간학이 발전시킨 인간상에 따라서 인간의 행태를 이들 현실 인자들에 조율해야만 한다.



In this article a focus is put on a comparison of Roman law and traditional law of Joseon Korea in the case of a self-sale contract. This originally was a contract by which a free person sold himself into servitude, when he suffered under a famine, to survive. Usually, however, its meaning also covers a sale of ones near relatives, especially children, grand-children and spouse, or occasionally even parents, grandparents etc. There occurred sometimes a sale of a free person who had no relationship with the seller. Roman law knew the latter two kinds, the law of Joseon Korea the former two kinds. It is astonishing to find out that in Korea, as far as the law of Joseon Korea is concerned, any significant study on the legal ascpects of the problem has been undertaken, although the forfeiture of the free status of a person was a critical issue at that time too. Most of studies have concentrated on the social or economic aspects. The legal consequences were usually also extended to the descendants of the person sold. These harsh effects of the contract were justified most tacitly with the survival of the concerned in view. The different rulings of Rome and Joseon can be explained to a certain extent from the fact that a Roman slave was near at a thing without any personal right, whereas the Nobi-system of Joseon Korea treated nobi (no as a bondman and bi as a bondwoman) nearly like a free person, permitting them to enjoy proprietary rights as well as rights of family law including marriage and inheritance. Thus, it seems that Roman law was more rigorous than the law of Joseon Korea in tolerating such a contract. However, this difference can not explain all of the different attitudes of both legal systems towards the issue. Roman legal culture was more inclined to argue from the basic viewpoint of its legal anthropology and to sanction in real legal terms more or less in detail. The law of Joseon Korea departed from the unavoidable material crisis of a persons life which the state could not overcome either, and was compelled thus to yield to the real conditions confronting them to the effect that it recognized the contract in a series of unwilling policies in the face of great famines. Legal arguments were not on the surface, but frequently moralizing justification such as pietas (above all filial reverence and love to the parents) came to the fore. The position of the sold was till the end of the dynasty very weak and meager, so that the interests of the nobi-owners prevailed even in the reforming royal decree of the King Gojong for the protection of such nobi and their descendants at the end of the 19th century. The comparison demonstrates, on the one hand, that great catastrophes like famines etc. belong to the condicio humana which may compel any one to surrender his freedom for his survival and, on the other hand, that a legal order always offers and can only offer legal solutions which necessarily leave much to be desired and incessantly transforms itself in reaction to the changing reality. And the very reaction of a legal order is fundamentally influenced by its legal anthropology. Legal methodology must always consider and reconsider real factors of the human life and adjust human behavior to them according to the Menschenbild its legal anthropology has developed.
