광역자치단체와 시·도교육청간 협력이 비법정전입금에 미치는 영향

Abstract

오늘날 지역별 교육수요가 늘어남에 따라 지방자치와 교육자치의 정치적 협력의 필요성이 더욱 커지고 있다. 지방교육자치제도의 한 형태로 2016년 조례화된 지방교육행정협의회는, 교육감과 시·도지사가 공동의장으로 구성된 조직체이며 특별히 지방교육재정과 관련한 법정·비법정전입금에 대한 세출예산 협의를 의무화하는 내용을 담고 있다. 교육행정협의회는 지방교육자치의 논의의 종지부가 되는 듯 했으나 기대와 달리 지방교육행정협의회가 개최되지 않거나 수년간 1, 2회로 그치는 등 당초 목적과는 다르게 운영의 어려움을 겪고 있다. 이에 따라 본 연구는 지방교육행정협의회의 개최요인과 지방교육행정협의회가 지방교육재정에 미치는 영향력에 주목하였다. 특히, 지방자치와 교육자치가 중복된 권한을 가지고 있는 비법정전입금에 대해서 재정의 자주권이 이동하는 문제를 살펴보았다. 분석결과로서 먼저 교육행정협의회 개최에 영향을 미치는 개최요인으로 누적운영기간이 부적영향력을 미치고 있었다. 누적운영기간별로 구분해보았을 때 운영 초반1-3년에 비해 누적운영기간이 길어질수록 개최가 되지 않는 것을 확인할 수 있었다. 둘째로 교육행정협의회는 당해 연도 비법정전입금에는 영향을 미치지 않지만 차년도 비법정전입금에는 공동의장이 참석한 교육행정협의회에 한하여 비법정전입금이 유의하게 증가하였다. 셋째로 비법정전입금의 전입비율의 경우 당해 연도에는 개최횟수에 유의한 영향력을 보였으며 차년도의 경우 공동의장이 참석한 협의회에 한해 유의하게 전입비율이 증가하는 것을 살필 수 있었다. 본 연구는 선행연구에서 다루지 못했던 지방교육행정협의회 개최에 영향요인을 실증적으로 분석하였다는 점과, 교육행정협의회를 통한 시도교육청의 재정 자주성 증진방안을 모색했다는 점에서 의의를 찾을 수 있다.

The demand for education is diversifying in the community. As a result, the need for cooperation between local governments and education administration has increased. The Local Education Administration Council introduced in this study is one of the local education autonomy systems. It was made into a law in 2016. The system is a place where the superintendent of education and the local governor consult, and deals with the budget for legal and non-legal transfers, particularly in relation to local education finance. Five years have passed since its establishment, and local education administration councils have not been held or operations have been restricted once or twice over the years. For this reason, the study analyzed the factors of holding a local education administration council. It also focused on the impact of the local education administration council on local education finances. In particular, the study focused on non-legal funds that overlap authority between local governments and educational governments. First of all, the analysis showed that the period of operation had a negative impact on the holding of the Education Administration Conference. The longer the operation period, the fewer meetings were held. Second, the Education Administration Council greatly increased non-legal transfers in the following fiscal year. Third, the rate of remittance of non-court transfers also increases significantly. This study is meaningful in that it analyzed the local education administration council in empirical ways. It is also meaningful in that the Local Education Administration Council has announced the expansion of economic autonomy.
