모빌리티 플랫폼 기업의 규제와 혁신

Abstract

Rapid IT technology growth has brought unprecedented change to our society. This big change not only affects individual consumers but also existing and newly rising companies. As core technologies like artificial intelligence, big data, blockchain, and autonomous driving, which represent the 4th industrial revolution have already started to infiltrate deeply into our daily lives, the rise of platform companies has become the bridge between the technology and the on-demand or gig economy. Although the platform companies are causing severe controversy with the conventional industry, many have celebrated them as positively disruptive, introducing much-needed competition in industries that have been otherwise overly mature and stagnant.

Especially, as platform companies like Google and Facebook emerged as powerful players in each domain, high interest in platform services appeared from related industries. Platforms were at the core of their great success and even became the key factor in whether they can survive in the market. On the other hand, the clash between the old and the new also implies new challenges to the current regulatory system. Moreover, as platform companies like Uber and Airbnb achieve great success, they also pose both new opportunities for, and challenges to consumer and employee welfare in the digital context.

In this paper, we examined diverse social changes and legal disputes due to the rise of platform companies. Among them, we looked into cases of the leading mobility platforms, Uber, and its Korean version, TADA, which have been causing serious friction with the existing taxi industry.

To this end, first, it is imperative to understand the economic aspect of the platform market and how its key characteristics are applied. Second, this paper addressed the main legal disputes that are being discussed among relevant industries as platform companies appeared in the market. Third, correlations between regulation and innovation per legal disputes were analyzed and pertinent legal solutions were discussed accordingly. Lastly, this paper highlights legal issues and future tasks on Robo-Taxi, as this will become a new area of discussion brought by the development of autonomous driving technology.

국문초록 정보통신기술의 비약적인 발전으로 우리 사회는 지금까지 보지 못한 새로운 세상을 경험하고 있다. 이러한 변화는 소비자인 개인뿐만 아니라 현존하는 기업과 새롭게 등장한 기업 모두에게 커다란 영향을 주고 있다. 인공지능, 빅데이터, 블록체인, 자율주행 등 4차 산업혁명을 대표하는 기술에 대하여 혹자는 아직 오지 않은 먼 미래의 기술이라고 할지 모르지만, 이러한 기술은 이미 우리 삶에 깊이 침투하기 시작했다. 이러한 기술의 발전은 온디맨드(on-demand) 혹은 긱 이코노미(gig economy) 시대와 연결해주는 플랫폼 기업이 등장하기 시작했다. 플랫폼 기업의 등장은 기존 산업과 심한 마찰을 일으켰지만, 혹자는 이 과정을 긍정적 파괴라 부르며 이들의 등장이 없었다면 과도하게 성숙하고 침체하였을 산업에 경쟁의 바람을 불러왔다고 환영했다.

특히 구글과 페이스북 등의 플랫폼 기업이 자신들이 가진 플랫폼이라는 강점을 활용하여 각자의 영역에서 강자로 부상하면서 유관 업계 내에서 플랫폼에 관한 관심이 높아지고 있다. 이들 기업의 성공 중심에는 플랫폼이 자리하고 있었고, 이는 한 기업의 성패를 좌우하는 핵심 요인으로 인식되기 시작했다. 한편, 기존 산업과의 충돌은 곧 기존 규제에의 중대한 도전을 의미하기도 한다. 우버(Uber), 에어비앤비(Airbnb) 등 공유경제를 새롭게 선도하는 플랫폼 기업이 대성공을 이루자 그들의 시장 지배력과 기술적 역량으로 인해 발생하는 새로운 형태의 반경쟁적 행위와 소비자 및 근로자의 후생에 미치는 부정적인 영향에 대한 의문도 함께 나타났다.

본고에서는 플랫폼 기업의 등장으로 발생하는 다양한 사회적 변화와 법적 쟁점에 대해 살펴보고자 한다. 그중에서도 최근 기존 산업과의 마찰이 큰 모빌리티 플랫폼 기업인 우버(Uber)와 그의 국내 유사 플랫폼인 타다(TADA)의 사례를 들어 플랫폼 기업이 우리 사회에 어떤 변화를 일으키는지 알아보았다.

이를 위해, 먼저, 플랫폼 시장의 주요 특징인 양면시장과 네트워크 효과가 플랫폼 기업에 어떻게 작용하는지 이해하는 것이 중요하기 때문에 경제적 관점에서 플랫폼의 특성을 분석하였다. 그다음으로 모빌리티 플랫폼의 등장으로 관련 산업에서 발생하는 다양한 법적 쟁점에 대해 살펴보았다. 또한, 각 법적 쟁점을 중심으로 관련 산업의 규제와 혁신의 상관관계를 분석하고, 어떻게 기존 산업과의 마찰을 줄이면서 기술적 혁신을 이룰 수 있는지에 대한 방안을 제시하였다. 마지막으로 자율 주행기술의 발전에 따라 고려해야 할 로보택시의 법적 쟁점과 향후 과제를 논의하였다.
