한국의 가상화폐 정책 변동과정의 분석

Abstract

Today, fiat currency continues to lose its function as a means of payment guarantee in many countries around the world. The unprecedented inflation caused by an unlimited quantitative easing of money is also obscuring the value of the currencies. In addition, a new wave of cryptocurrency triggered by advances in Information Technology(IT) is changing the paradigm of money itself. While expanding into the global market, cryptocurrency is expected to be issued in various forms. Generally, it refers to digital currencies that use distributed ledger technology based on blockchain. The blockchain is a type of database that stores encrypted data blocks then chains them together to form chronological encrypted information for a transaction. It also means a data structure where the relevant technology is integrated. With advances in blockchain technology, new cryptocurrencies are now being developed and issued. However, we often see many of its side effects, such as illicit activity in its usage like money-laundering or financing of terrorism activities in breach of international norms. On the other hand, the global distribution market for cryptocurrencies has rapidly been expanding. In particular, the crisis caused by the COVID-19 has helped increase the awareness of the usability of cryptocurrencies. Therefore, this study is designed to state the point of argument on the need for rational regulations and authorities for the vitalization and development of its market rather than meaningless regulations on cryptocurrencies. Hard regulations on cryptocurrencies such as Bitcoin are likely to hinder the development of its entire ecosystem. Accordingly, it may limit the innovation of cryptocurrency utilizing blockchain technology which seeks decentralization. Therefore, countries worldwide are required to approach cryptocurrencies from a long-term and rational perspective. In other words, rather than creating and applying new regulations on the blockchain, they need to suggest consistent and reasonable policies and establish an administrative system for stable settlement and dissemination of cryptocurrencies. In this study, the changes in domestic policies on cryptocurrency are analyzed thoroughly based on the Advocacy Coalition Framework (ACF) which is a model for analyzing public policies proposed by Paul Sabatier (1988). In addition, the policy suggestions and considerations for the ideal development of future domestic cryptocurrency are suggested based on the above results. The results present stable external variables that consider cryptocurrency as speculation as well as dynamic external variables such as rapid digitalization, a sudden rise of investment instruments, and favorable public opinions. It is confirmed that the conflicts between two variables also create two different advocacy coalitions supporting strict regulations on cryptocurrency and the other opposing such. Moreover, it has accelerated the competition of each advocacy coalition on their policies due to external factors such as changes in perspectives in response to the trend of official issuance of cryptocurrencies in some countries and its heightened usability caused by COVID-19 as well as internal factors such as discussions and petitions by supporters for vitalization of cryptocurrencies within the strongly regulated groups. As a result, the Special Financial Transaction Information Act was presented to institutionalize and embrace cryptocurrencies. However, it is difficult to observe policy orientation or initiative process among policy brokers. Therefore, it is confirmed that they failed to find a middle ground on regulations, arbitration, and coordination of cryptocurrency claimed by each advocacy coalition. Currently, the definition of cryptocurrency is not completely established in Korea. That explains why Korea is falling behind in fostering promising industries and protecting customers related to cryptocurrencies, which is now a global trend. In particular, administrative systems for cryptocurrencies have not yet been settled, resulting in confusion in policies among government departments. Therefore, this study convincingly suggested the necessity and policy directions of cryptocurrency by establishing a specialized institution in the government to enhance the level of expertise related to cryptocurrencies. Based on them, it also presented that policy brokers should reconcile the opinions of each group and create policy-oriented learning on policy directions and revitalization of cryptocurrencies considering the status of Korea to promote its balanced legislation. Now, the important mission of the financial authorities is to review any legal restrictions or side effects that could occur at this experimental stage and reduce any uncertainties of the market, which may be considered as a balanced perspective on cryptocurrency that is rapidly expanding. The cryptocurrencies are garnering much attention, with many active discussions on whether they could be considered as legal assets such as money or commodity. Therefore, the government in Korea needs to promote rational regulations and provide support by each industry on its matter instead of simply considering transactions of cryptocurrencies as speculation or gambling. In addition, brokers in the private sector shall put much effort into reducing any social and economic side effects caused by cryptocurrency transactions, which can often be regarded as investment or speculation. Through this, the blockchain industry as a whole shall help form a social consensus in policies. As mentioned above, cryptocurrency is seen as an unprecedented paradigm created with new technology in a new environment. That explains why it is highly volatile and ambiguous compared to existing traditional legal tender. The complicated environment where conflicts often occur between stakeholders puts enormous pressure on cryptocurrency, which may lead to establishing strict laws and regulations to protect the traditional currency industry. Considering the unique characteristics of cryptocurrencies, government should focus on clarifying the responsibilities of its governmental organizations and conduct policy research from the early stage. In particular, the authorities, expert groups, citizens, and advanced global institutions should secure a smooth communication channel to seek a systematic approach to minimize social confusion by establishing a forum for public discussion. In addition, they need to properly reconcile their opinions and review the impacts of new cryptocurrency on domestic society and economy to establish balanced laws and regulations for industry revitalization plans specialized in the domestic market. Only then may they minimize various trials and errors and establish rational regulations designed to activate the industry before the cryptocurrency is officially used.

오늘날 세계 곳곳에서는 지급보증의 기능마저 상실한 화폐들이 속출하고 있으며, 이러한 기존 화폐의 무제한적인 양적 완화(QE)로 인한 초유의 급격한 인플레이션은 본연의 통화로서의 가치마저 퇴색시키고 있다. 여기에 IT 기술의 눈부신 발전으로 촉발된 가상화폐라는 새로운 물결은 화폐 자체의 패러다임을 바꾸고 있다. 현재 전 지구적으로 급격하게 확장세를 보이는 가상화폐는 향후 더욱 다양한 형태로 발행될 전망이다. 오늘날 통용되는 가상화폐의 일반적인 정의는 블록체인 기반 분산원장기술을 이용한 디지털 화폐를 일컫는다. 여기서 말하는 블록체인이란 암호화된 거래정보가 기록된 블록이 순차적으로 다음 블록으로 기록됨으로써 연결되는 데이터베이스나 해당 기술이 집약된 데이터 구조를 말한다. 이러한 블록체인의 기술 발달과 함께 새로운 가상화폐가 개발, 발행되고 있지만 이에 수반한 불법행위 악용 등의 부작용도 빈번하게 발생하고 있다. 그러나 한편으로 전 세계에 걸쳐 가상화폐의 유통 규모는 급속하게 증가하고 있으며, 특히코로나19 바이러스로 인한 전례 없는 위기 상황은 가상화폐의 유용성에 대한 인식을 증대시켰다. 이에 따라 본 연구는 가상화폐에 대한 무조건적인 규제가 아닌 해당 산업의 활성화 및 발전을 위한 합리적 규제가 필요함에 그 논지를 개진하게 되었다. 비트코인을 비롯한 가상화폐에 대한 강도 높은 규제는 가상화폐 생태계 전반에 걸쳐 발전을 저해할 여지가 충분히 있으며, 이에 따라 분산화 및 탈중앙화를 추구하는 블록체인을 활용한 가상화폐의 혁신에 있어서 상당 부분 제한을 가져올 수 있다. 따라서 각국 정부는 가상화폐 문제를 보다 장기적이고 합리적인 관점에서 접근해야 할 필요가 있다. 다시 말해 블록체인과 관련하여 신규 규제만을 지속적으로 생성하고 적용하기보다는, 현 단계에서는 시장에 가상화폐의 안정적인 정착과 보급을 위한 일관성 있고 합리적인 정책을 제시하고 행정적인 제도를 구축하는 것이 우선되어야 한다. 이에 본 고에서는 정책집행옹호모형에 따라 국내의 가상화폐 정책변동 과정을 자세히 분석하였고, 그 결과를 바탕으로 향후 국내 가상화폐의 이상적인 발전을 위한 정책 방향을 제시하고자 했다. 분석 결과, 가상화폐를 투기로 간주하는 안정적 외적 변수와 함께 급격한 디지털화, 투자상품의 급부상, 여론의 우호적 시선이라는 역동적 외적 변수가 생성되었고, 이들 간 상충의 결과로 가상화폐에 대한 강력한 규제를 지지하는 옹호 연합과 강력한 규제에 반대하는 옹호 연합이 각각 생성되었음을 확인할 수 있었다. 또한, 일부 국가들의 가상화폐의 공식 발행 트랜드에 따른 인식변화 및 코로나19로 인한 가상화폐 유용성 인식이라는 외부충격과 강력규제 집단내의 가상화폐 활성화를 일부 지지하는 집단의 토론 및 청원 등 내부충격에 따라 각 옹호 연합 간의 정책 경쟁이 가속화되었고, 결과적으로 가상화폐를 제도화하여 포섭하려는 움직임에 따라 특금법이라는 정책이 산출되었음을 확인했다. 그러나 이 과정에서 정책중개자 역할에 따른 정책지향학습이 발생하지 않아 각 옹호 연합이 주장하는 가상화폐 규제, 중재, 조율 결과에 따른 절충안이 도출되지 못함을 아울러 확인할 수 있었다. 현재 국내의 경우 가상화폐에 대한 개념 정의도 완전하지 않은 실정이다. 이로 인해 전 세계적인 추세라고 할 수 있는 가상화폐에 관련된 유망산업의 육성 및 소비자 보호에도 뒤처지고 있다. 특히 현재 정부 부처 간에 가상화폐에 대한 행정적 제도에 관한 논의가 정리되지 않아 정책의 혼선이 발생하고 있음은 주지의 사실이다. 이에 본 연구는 가상화폐에 관련하여 전문성을 증진하기 위해 정부 부처 내에 가상화폐 관련 전문기관을 창설하여 가상화폐 활성화의 필요성과 방향성을 설득력 있게 제시했다. 나아가 이를 기반으로 정책중개자는 각 집단의 의견을 적절히 조율하여 국내 사정에 적합한 가상화폐의 규제 방향과 활성화 방안에 관해 정책 지향적 학습을 창출하여 가상화폐에 관한 균형 있는 입법을 추진해야 함을 제시했다. 현재 금융당국의 중요한 역할은 가상화폐에 관해 일종의 실험단계인 현시점에 발생할 수 있는 법적인 제한사항이나 부작용 등을 검토하여 시장의 불확실성을 감소시켜주는 일이며, 이는 오늘날 가속화되고 있는 가상화폐에 관한 균형 잡힌 시각일 것이다. 오늘날 비트코인 등의 가상화폐가 법적으로 통용 가능한 자산(화폐, 상품 등)으로 상정할 수 있는지에 대한 논의가 활발히 이루어지고 있을 만큼 가상화폐는 세계적으로 주목받고 있다. 이에 따라 우리 정부도 단순히 가상화폐 거래를 투기나 도박이라고 단정함으로써 법적 규제만을 우선적으로 제시하기 전에 개별 산업의 현장에서 각 단위에 특화된 합리적 규제와 지원을 동시에 추진해야 할 것이다. 아울러 민간 부문의 가상화폐 관련 기업들은 투기와 투자를 오가는 가상화폐 거래로 인한 각종 경제적, 사회적인 부작용을 줄이기 위한 노력을 통해 이를 뒷받침해야 하며, 이를 통해 정책 부분에 있어서 블록체인 업계를 비롯해 전(全) 사회적인 합의가 도출되어야 할 것이다. 앞서 언급했듯이 기본적으로 가상화폐는 새로운 기술과 환경 속에서 생성된, 선례가 없는 새로운 패러다임이기 때문에 기존의 전통, 법정화폐에 비해서 높은 변동성과 모호성을 가지고 있다. 이러한 복잡한 환경과 이해관계자 간 갈등에 따라 강도 높은 압력 상황이 연출되기 마련이고, 그 결과 기존의 전통 화폐 산업을 보호하기 위해 가상화폐에 대한 강도 높은 규제 입법으로 귀결되기 쉽다. 가상화폐의 이러한 특징을 고려할 때, 정부는 초기부터 책임부처를 명확히 하고 정책연구를 시행하는 등 사전적인 대응에 중점을 두어야 한다. 특히 당국과 전문가 집단 및 시민사회, 아울러 글로벌 선진기관 간에 원활한 소통 채널을 조기에 확보하여 공론의 장을 형성하는 등 사회 혼란을 최소화하는 체계적 접근방안을 모색해야 할 것이다. 이렇게 각 집단의 의견을 적절히 조율하여 새로운 가상화폐가 국내 사회와 경제에 미치는 영향에 대해 면밀히 검토하여 국내 사정에 특화된 가상화폐의 규제 및 산업 활성화 방안에 관해 균형 잡힌 법을 제정하고 정책을 도출한다면, 우리의 일상생활에 가상화폐가 정착하기 전 발생할 수 있는 여러 시행착오를 최소화하고 해당 산업 활성화를 위한 합리적 규제가 정착될 것이다.
