하버마스의 권리의 체계 재구성: 그 논증 전략과 보완 방안

Abstract

미 법철학･정치철학의 고전이 된 하버마스(Jürgen Habermas)의 『사실성과 타당성』은 다양한 심화 연구의 대상이 되고 있으나, 그 핵심 논증에 초점을 맞춘 연구는 찾기 어렵다. 본 연구는 『사실성과 타당성』의 핵심 논증, 즉 권리의 체계 재구성을 탐구한다. 권리의 체계를 재구성하는 논증 전략은 논증대화원리와 법형식의 상호 침투 논증이다. 상호 침투는 두 단계로 이루어진다. 1단계에서는 법코드 작동에 요구되는 권리 범주를 도입하고, 2단계에서는 민주적 절차의 제도화에 필요한 권리 범주를 도입한다. 상호 침투 논증의 강점은 근대 사회에서 나타나는 법과 도덕의 분화 현상에 부응한다는 점이다. 상호 침투 논증의 약점은 규범적 성격이 약한 전제에서 규범적 성격이 강한 결론을 어떻게 도출하는지가 불분명하다는 점이다. 이 약점은 의사소통적 합리성과 도구적 합리성을 명시적으로 도입함으로써 보완할 수 있다.

Jürgen Habermass Between Facts and Norms, already a classic in legal and political philosophy, has been the subject of research in various aspects, but few focus on its core argument. This study delves into the core argument in Between Facts and Norms, i.e., the reconstruction of system of rights. The argument strategy is the interpenetration of discourse principle and legal form. This interpenetration occurs in two steps: in the first stage, rights required for the operation of legal code are introduced, and in the second stage, rights necessary for the institutionalization of democratic procedures are introduced. The strength of this argument is that it responds to the differentiation of law and morality in modern society. Its weakness is that it is unclear how a rather normative conclusion is drawn from premises that are much less normative. This could be remedied by incorporating communicative and instrumental rationality as explicit elements of the argumentative process.
