감염병 시대의 방역과 기본권보장의 쟁점

Abstract

감염병의 방역을 위한 조치들은 개인의 자유와 권리에 대한 중대한 제한들을 초래한다. 감염병예방법이 규정하고 있는 집합금지, 시설폐쇄, 강제적인 건강진단과 입원 또는 격리, 이동경로 등 정보공개 등은 기본권제한의 정도가 적지 않다. 방역정책의 수립과 집행에는 전문성이 요구되므로 행정기관으로의 권한위임 현상은 어느 정도 불가피하지만, 어떠한 기본권에 대하여, 어느 정도의 제한을 감수하면서 방역정책을 선택할 것인지는 공동체 구성원 스스로의 의사에 따라 결정되어야 하므로 전문성을 이유로 한 행정기관의 권한위임에 대해서도 민주적 통제는 필요하다. 방역정책에서 요구되는 전문성과 방역의 위기상황을 근거로 기본권침해의 심사기준을 완화하여야 한다는 주장도 제기될 수 있으나, 심사기준을 일률적으로 완화하지 않더라도 개별 사안에서의 특수성을 고려하면 얼마든지 적정한 결론을 보장할 수 있다. 방역의 특수성을 들어 심사기준을 일률적으로 완화하면 방역이라는 이름으로 행해지는 부당한 기본권침해를 적절히 통제할 수 없는 결과를 초래할 수 있다. 감염병의 유행으로 인해 국민의 생명과 건강, 생계가 위협받는 상황에서 건강권을 비롯한 사회적 기본권과 국가의 기본권보호의무에 대한 재조명이 요구되는데, 오늘날 사회적 기본권과 국가의 기본권보호의무의 중요성이 갈수록 중요해지는 현실을 감안할 때, 문제되는 기본권적 법익의 내용에 따라 심사기준을 보다 엄격하게 적용할 필요가 있다.

The measures to control and prevent infectious diseases such as prohibition of mass-gathering, closure of facilities, compulsory medical examination, hospitalization or quarantine, and disclosure of personal information, restrict individual freedom and rights substantially. In the area of public health policy, which requires expertise, the delegation of authority to an administrative agency is inevitable to some extent. However, the final decision on public health policy should be decided by the people with democratic procedure. The ordinary standard of judicial review should be applied to the public health law even in times of crisis of pandemic. Loosening of standard may lead to failure of protection of constitutional rights. In times of the pandemic of infectious disease, it is necessary to revisit the social rights and the states duty of protection of constitutional rights. It is required to apply heightened scrutiny standards of judicial review especially on the right to health and states duty of protection of it.
