건축 표절 논의를 위한 미학의 차용 적용에 관한 연구

Abstract

저작권법으로 건축 표절을 판단하는 것은 건축의 '주리스토크라시'이다. 건축 표절은 비평을 통해 판단되어야 한다. 비평의 측면에서 건축 표절을 논하기 위해서는 예술 모방에 관한 연구가 선행되어야 한다. 현재 건축 표절은 예술 모방을 고려하지 않아 여전히 표절이다와 표절이 아니다의 이분법적 판단에 머물러 있다. 비평의 측면에서 건축 표절은 창조, 차용, 표절로 구분해서 판단해야 한다. 미학에서는 예술 모방을 차용 이론으로 정리했고 현대미술은 다양한 차용작품을 통해 발전하고 있다. 본 연구의 목적은 미학의 차용 이론이 건축에서도 적용 가능한지 살펴보고 이를 통해 건축 표절 논의에 차용의 범주를 제안하는 것이다. 차용 이론이 적용된 건축 표절 논의는 건축 창조의 범주를 넓히고 저작권법이 아닌 건축비평의 측면에서 건축 표절에 관한 논의를 유도할 것이다. 본 연구에서는 차용작품이 되기 위한 미학의 기준을 정리하고 해당 기준으로 건축물의 표절 의혹이 있는 사례 중 차용과 유사한 개념을 주장하는 건축 사례를 분석했다. 분석의 대상은 글라스 하우스, 호주국립박물관, 메이콴 22nd 센츄리 이며 차용미학의 관점에서 글라스 하우스만 건축 차용으로 판단되었고 호주국립박물관과 메이콴 22nd 센츄리는 건축 표절 판단 기준을 적용해서 판단해야 한다는 결과가 나왔다.

It is the juristocracy in architecture to judge the architectural plagiarism by copyright law. The architectural plagiarism should judge byarchitectural criticism. From the point of the criticism to discuss architectural plagiarism, the study on artistic imitation should bepreceding. The current discussion on architectural plagiarism doesnt consider artistic imitation. Therefore, the result of the discussion onlyfocused on whether the building is plagiarizing or not. From the point of architectural criticism, there should be three considerations, whichare creation, imitation, and plagiarism. In the study of Aesthetics, it theorized artistic imitation as the appropriation. With the understandingof the appropriation, contemporary art is developing the discourse on plagiarism beyond the boundary of plagiarism fundamentalism. Thepurpose of this study is to apply the appropriation to the discussion of architectural plagiarism. The study introduces the discourse onarchitectural plagiarism rather than judging it with copyright law. There so the study categorized the aesthetics standard of appropriationart, then apply it to the architecture cases. The architecture cases subjects of analysis are the glasshouse by Philip Johnson, NationalMuseum of Australia by Howard Raggatt, and the Meiquan 22nd Century in China. At the point of the appropriation theory, theglasshouse is the only architectural appropriation, and others need to apply the evaluation criteria of plagiarism.
