공작물책임의 경제적 분석‒ 하자 개념과 핸드 공식(Hand Formula) ‒

Abstract

공작물 책임의 요건인 공작물의 설치 또는 보존의 하자는 무엇을 의미하는가에 관하여는 종래 객관설과 의무위반설의 대립이 있다. 근래의 판례는 의무위반설을 따르는 것이 많 다. 그런데 최근에 선고된 대법원 2019. 11. 28. 선고 2017다14895 판결은 하자를 인정하는 기준으로서 핸드 공식 또는 핸드 룰을 참고할 수 있다고 하였다. 즉, 사고 방지를 위한사전조치를 하는 데 드는 비용(B)과 사고가 발생할 확률(P) 및 사고가 발생할 경우 피해의정도(L)를 살펴, B_P ․ L인 경우에는 공작물의 위험성에 비하여 사회통념상 요구되는 위험방지 조치를 다하지 않은 것으로 보아 공작물의 점유자에게 불법행위책임을 인정하는 접근방식도 고려할 수 있다는 것이다. 이 글에서는 공작물책임의 요건인 하자 개념에 관한 종래의 법학적 논의를 개관하고, 핸드 공식을 소개한다. 그리고 우리나라의 판례뿐만 아니라 미국과 독일의 판례도 실제로 재판에서 핸드 공식을 고려하고 있다는 점을 확인한다. 결론적으로 핸드 공식은 하자 여부를 판명함에 있어 유용한 도구가 될 수 있다.

About the meaning of defect in the construction or maintenance of a structure, which is the condition of structure liability, there is a controversy between objective theory and breach of duty theory. The majority of recent precedents adopts the breach of duty theory. The Korean Supreme Court decision on November 28, 2019, case nr. 2017da14095 declared that in deteremining the defect, the so called Hand formula may be considered. According to this formula, if B (the burden of adequate precautions to prevent the accident) is less than L (the resulting injury) multiplied by P (probability of accident), the liability should be recognized. This paper briefly sketches the legal debate on the meaning of defect and introduces the Hand Formula. And it will be shown that the precedents of Korea, U.S., and Germany are considering the Hand formula. Lastly, it asserts that Hand formula can be a useful device for determining the defect.
