사회적 형평성의 정의론적 논거 모색: '응분의 몫(desert)' 개념을 중심으로

Abstract

행정이 추구해야 할 중요한 이념으로서 사회적 형평성에 대한 연구는 매우 미약하다. 신행정학이 등장하던 1960년대 말부터 70년대 초반까지 Rawls의 정의론에 의존해서 사회적 형평성의 정의론적 근거를 제시한 것 말고는 이렇다 할 이론적 논의가 전개되지 않았다. 사회적 형평성은 정의론 자체를 의미하기보다는 하나의 정의원칙이 현실에 융통성 있게 적용되도록 하는 조절이념이거나 다양한 정의원칙들을 상황에 맞게 적용할 수 있는 기준이나 다양한 원칙들이 바람직하게 배합될 수 있는 방법을 찾는 조절이념이라 할 수 있다. 따라서 사회적 형평성은 하나의 정의이론에 의존하는 것에서 탈피하여 다양한 정의이론이 형평성 있게 적용될 수 있는 방법을 찾는데 초점을 맞추는 것이 바람직하다. 따라서 본 논문은 Rawls가 포함되어 있는 자유주의적 평등주의 진영에서 활발하게 이루어지고 있는 이론적 논쟁에 주목하였고, 그 가운데에서도 응분의 몫(desert)에 초점을 맞추었다. 이 글에서는 응분의 몫을 우선 일반적인 정의 관념의 근간으로서 다루었다. 그것은 제몫을 갖는 것, 동일한 경우는 동일하게 다루는 것과 같은 정의관념을 구성한다. 다음으로는 다양한 정의원칙들과 경쟁하는 하나의 정의원리로 다루었다. 기본 모형은 P(주체)가 B(응분의 몫의 근거) 때문에 당연히 T(응분의 몫)를 가질 만하다이다. 본 논문에서는 이처럼 두 차원에서 응분의 몫 개념을 정리하고, 다양한 쟁점들을 살펴보았다. 그리고 이러한 응분의 몫 개념이 사회적 형평성과 어떠한 연관이 있으며, 행정에 대해서는 어떠한 이론적 함의를 갖는지를 살펴보았다. Social equity is a central idea of public administration that civil servants must pursue. In spite of its importance, there are few studies on that concept. At most, there was a study on social equity based on Rawls' theory of justice by new public administration theorists. Social equity is an adjusting idea that makes arranges and applies various principles of justice flexibly in a variety of concrete situations. Therefore, in order to refine the theory of social equity, it is desirable to consider various theories of justice. This article intends to expand the theoretical horizon of social equity. For this aim, this article focuses on the concept of 'desert,' which has provoked a number of disputes in the political philosophy of liberal egalitarianism. In this article, desert is treated in two aspects. On the one hand, desert is treated as the root of the general notion of justice. On the other hand, it is treated as a principle of justice that competes with other principles of justice. Desert is not a definite concept with a shared definition that justice theorists agree on. So this article examines some points of controversy. Finally, this article critically examines desert in the light of social equity, and suggests the significance of desert to public administration.
