규제영향분석의 실효성에 대한 이론적 논의

Abstract

정부가 기업이나 시민들에 가하는 규제는 과연 어떤 경우에 정당성을 가지는가? 규제선진국으로 일컬어지고 있는 OECD 국가의 경우 규제로 인한 편익이 비용보다 크면 규제는 정당성을 확보한다고 본다. 세계 각국은 규제로 인한 비용과 편익을 경제학적 방법론을 원용하여 측정하는 규제영향분석을 발달시켰고 RIA는 정부정책을 집행하는 논리체계로서 기능하고 있다. 본 논문은 RIA의 한계와 무용론을 주장하는 부정적인 논거들을 정리하고 경제적 합리성이 아닌 정치적 합리성이 지배하는 정책결정과정으로 인해 역설적으로 RIA가 실효성을 입증 받고 있다는 반론을 제기하였다. RIA에 대한 비판적인 평가는 크게 5가지 범주로 정리할 수 있다. 비용과 편익의 계량화에 대한 논란, 통계조작의 가능성, 공리주의 철학에 바탕한 형평성 무시, 경제학자의 왜곡된 정치참여욕구, RIA가 또 다른 형식주의라는 것 등이다. 그러나 이러한 한계에도 불구하고 정책결정과정을 합리성 기준에서 분석해보면 정치적 합리성과 경제적 합리성이 서로 경합하지만 궁극적으로 정치적 합리성을 극대화하기위해 경제적 합리성을 동원하게 되고 결국 경제적 합리성에 바탕을 둔 RIA는 유용한 수단으로 기여함을 알 수 있었다. 따라서 RIA가 좀 더 유용한 의사결정수단이 될 수 있도록 방법론적 문제점들을 해결하려는 노력을 기울일 필요가 있다. On what conditions can government regulations be justifiable? In OECD countries the regulation is justified when the benefits of regulations are bigger than the costs. The Regulatory Impact Analysis (RIA) has been developed by economists in order to analyze the costs and benefits of regulations, and most countries have utilized the RIA as a logical tool for analyzing regulations. This article analyzed the negative perspectives of the RIA - the limit of quantification of benefits and costs, the possibility of fabricating statistics, the lack of fairness, the distortion by economists, and also red tapes. Nevertheless, the RIA is a useful tool in the decision making process because the economic rationality strengthens the political rationality in the decision making process. Therefore, the skills and methods of the RIA should be developed in the decision making process.
