스위스 다문화주의의 도면: 연방 법제도와 정당제를 중심으로

Abstract

스위스를 가리켜 다양성(diversity) 그 자체라고 정의하는 이유는 다양한 통치조직 뿐 아니라 다양한 언어와 종교, 그리고 문화를 수용하고 심지어 현재에는 전체 인구의 20%가 외국인으로 구성된 의지에 의한 국가 (willensnation 또는 nation by will)이기 때문이다. 이러한 독특한 의지는 스위스 헌법에 명확하게 명시되어 있다. 그렇다면 스위스 사회상에 내포된 문화적 다양성이 스위스 헌법 조문에 명기되어 있기 때문에 스위스의 다문화주의가 그에 상응하는 정치적 영향력을 가지는가? 아니면 헌법 조문에 명기되어 있음에도 불구하고 소수 집단을 규정하지 않는다는 한계를 연방 법제도와 정당제를 통해 실질적으로 극복하려는 정치적 의지가 있기 때문에 결과적으로 다문화주의의 정치적 영향력이 생성되는가? 본 논문은 이러한 논제에 답하기 위해 헌법 조문에서 명시된 또는 명시되지 않은 다양성을 연방국가 간 비교하면서 문화적 다양성을 설명하는 이론적 틀을 이해한 후 스위스가 원론적으로 문화적 다양성을 수용하면서도 다문화사회의 소수 집단 구성원들을 명확하게 규정하지 않는 현실적 괴리를 법제도와 정당제를 통해 보완하고 있음을 분석하여 스위스 다문화주의의 도면을 그려내고자 한다.

The modern Switzerland appears well integrated such that Swiss polity is often dubbed as the embodiment of diversity. Switzerland is indeed the willensnation or the nation by will precisely because it embraces the peculiar multiplicities of government machineries, languages, creeds, and cultures. Even foreigners make up about 20 percent of Swiss population. This unique will is expressed in the Federal Constitution of the Swiss Confederation. Then, is cultural diversity politically valid in accordance with its constitutional specification? Or, is multiculturalism turned into a central pillar of nationhood because Switzerland manages to surmount the limits of the constitutional silence on the conception of the minority with the legal-institutional federalism and party system? To answer this question, I first compare the texts of constitution in 7 federal states while conceptualizing cultural diversity and then explore to sketch how the multiculural Switzerland is attributed to the legal-political federalism in conjunction with the party system.
