절차적 민주주의와 실질적 민주주의의 지양 －R. Dahl과 J. Cohen의 민주주의론을 중심으로－

Abstract

민주주의론들 사이의 논쟁들 중 대표적인 것이 절차적 민주주의 대 실질적 민주주의 사이의 논쟁인데, 영어권에서 절차적 민주주의는 다알(R. Dahl)의 민주주의론에 의해서, 실질적 민주주의는 코헌(J. Cohen)의 이론에 의해 대표된다. 이 논쟁의 맥락을 배경으로 해서, 필자는 이 논문에서 절차적 민주주의와 실질적 민주주의를 지양하는 민주주의론을 제시하고자 하였다. 그러기 위해서 필자는 우선 민주주의론의 적절성의 조건들을 밝혔는데, 이런 적절성의 조건들은 적절한 민주주의론은 한편으로는 현실적인 적실성과 인민주권을, 그리고 동시에 다른 한편으로는 민주적 정당성을 적절히 수용해야 한다는 것이다. 그런데 다알의 절차적 민주주의는 현실적으로 적실하고 충분히 민주적이라는 장점을 갖지만, 민주적 정당성을 적절하게 수용하지 못한다는 단점을 가지고 있고, 코헌의 실질적 민주주의는 민주적 정당성을 충분히 수용한다는 장점을 가지고 있지만, 현실적으로 적실하지 않고 불충분하게 민주적이라는 단점을 가지고 있다. 그래서 필자는 기본적으로는 다알의 절차적 민주주의를 받아들이면서 코헌의 심의민주주의적 요소들을 상당한 정도로 수용하는 절차적 자유민주주를 제시하는데, 이런 절차적 자유민주주의는 자유주의와 민주주의가 실질적으로 분리될 수 없다는 자유민주주의론이다.

Among the disputes between competing democratic theories, the dispute between procedural democracy and substantive democracy stands out. In the English speaking world, Cohens populist democracy represents procedural democracy and Cohens deliberative democracy represent substantive democracy. In the context of this dispute, I attempt to propose an adequate democratic theory. To do this, I first of all identify conditions for an adequate democratic theory. These conditions, on the one hand offer practical relevance and popular sovereigntyand on the other hand, democratic legitimacy. Given the adequate conditions, procedural democracy can well accomodate practical relevance and popular sovereignty, but cannot well accommodate democratic legitimacy. Substantive democracy might well accommodate democratic legitimacy but cannot well accommodate practical relevance and popular sovereignty. I basically adopt procedural approach, but amend its defects with strong points of deliberative democracy. Therefore, I propose a version of procedural liberal democracy which holds that liberalism and democracy are practically inseparable.
