DMZ 세계평화공원 조성을 위한 법적 기초

Abstract

The Demilitarized Zone in Korean Peninsular (DMZ) has been the symbol of military tension and conflict in the world and two Koreas. It could correspond with constitutional principle in pursuit of peaceful unification to make World Peace Park in DMZ. This can enforce international cooperations and realize environmental and cultural

virtues of unified Korea. According to international law, the Military Armistice Agreement on Korean Peninsular applies to DMZ and the committee for Military Armistice has jurisdiction over DMZ. The southern area of Military Demarcation Line is regulated by the Protection Law for Military Bases and Installations. Furthermore, some agreements are concluded for trades and cooperations between South and North Korea. Nevertheless, in order to construct sustainable and effective World Peace Park in DMZ, it is required to get rid of legal obstacles and establish legal infrastructure for ecological preservation and peaceful use of World Peace Park in DMZ.

At first, we have to get legal jurisdiction or superintendence on the site of DMZ for the World Peace Park. The ownership for the site of DMZ has to be secured by the government for the World Peace Park. The military installations including mines should be removed for security in on environment-friendly way. In addition, South and North Korea have to conclude some agreements for World Peace Park in DMZ and have these agreements get to be effective. Lastly, the special law should be prepared for positive support for World Peace Park in DMZ.

남북한이 분단된 이후 비무장지대(DMZ)는 국제적 냉전과 남북관계의 군사적 긴장과 갈등을 상징하여 왔다. DMZ에 세계평화공원을 조성하는 것은 평화통일을 지향하는 우리 헌법에도 부합하며, 군사정전협정의 규범력을 제고시켜 국제사회의 협조를 강화하는 한편, 통일한국의 환경·문화적 가치를 실현하는 수단이 된다. DMZ에 대하여는 국제법으로서 군사정전협정이 적용되어 군사정전위원회가 관할권을 가지며, 국내법으로는 군사기지 및 군사시설 보호법이 군사적 목적을 위해 적용되고 있다. 남북한 사이에는 교류협력사업을 위해서 부분적으로 남북합의서가 체결되어 있다. 그러나 DMZ에 세계평화공원을 안정적이고 효율적으로 조성하기 위해서는 법제도적 장애를 제거하고, 생태적 보존과 평화적 이용을 위한 법제도적 인프라를 구축해야 한다.

세계평화공원을 조성하기 위해서는 DMZ의 사업부지에 관한 관할권 또는 관리권을 확보해야 한다. 사업부지에 대한 토지소유권을 확정하고 이를 국유화하는 것도 필요하며, 지뢰 등 군사시설도 친환경적인 방법으로 제거해야 한다. 또한 세계평화 공원에 대한 남북합의서를 체결하고 그 법적 구속력을 확보해야 한다. 세계평화공원을 안정적으로 지원하기 위해서는 그 법적 근거와 지원을 마련하는 특별법도 제정해야 할 것이다.
